Medical Certificate, Family Application and Appeal"},"content":{"rendered":"<p>A British pensioner living in France can ask a French court to open an adult-protection measure when illness, dementia, disability or an accident makes it impossible to manage personal or financial affairs safely. Brexit does not remove that possibility, and a British passport does not by itself prevent a French judge from acting. The decisive questions are the person\u2019s habitual residence, the medical evidence and the least restrictive measure that will genuinely protect them.<\/p>\n<p>The French words matter. <em>Curatelle<\/em> is a court-supervised assistance measure: the person keeps substantial decision-making powers but receives support for important acts. <em>Tutelle<\/em> is a representation measure for a person who must be represented continuously. A <em>sauvegarde de justice<\/em> is a temporary protective measure, often used when a quicker and lighter response is needed. The judge is the <em>juge des contentieux de la protection<\/em>, meaning the protection litigation judge. This article explains the French test, the cross-border position of a British family, the application documents, the choice of a family member or professional representative, and the 15-day appeal route if the application is refused or the wrong measure is ordered.<\/p>\n<h2>I. Can a British pensioner in France get curatelle or tutelle, and which measure fits?<\/h2>\n<h3>A. What do curatelle, tutelle and sauvegarde de justice actually do?<\/h3>\n<p>French adult protection begins with the person, not the passport. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427435\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427435\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 425 of the Civil Code<\/a> applies where there is an impairment of mental or bodily faculties that prevents the person from looking after their interests. The statutory wording refers to an \u201c<q>alt\u00e9ration, m\u00e9dicalement constat\u00e9e, soit de ses facult\u00e9s mentales, soit de ses facult\u00e9s corporelles<\/q>\u201d. In plain English, a diagnosis alone is not enough. The medical condition must have practical consequences for the person\u2019s ability to understand, decide, communicate or carry out important acts.<\/p>\n<p>The purpose is protective rather than punitive. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006070721\/LEGISCTA000006150530\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006070721\/LEGISCTA000006150530\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 415 of the Civil Code<\/a> states that the measure has \u201c<q>pour finalit\u00e9 l&#8217;int\u00e9r\u00eat de la personne prot\u00e9g\u00e9e<\/q>\u201d and should promote autonomy where possible. The court therefore looks at the actual danger: unpaid bills, exploitation, unsafe contracts, repeated banking fraud, inability to consent to care, loss of housing, or a breakdown in the management of a French or UK pension. A family disagreement, a different lifestyle, an English accent, or the fact that a son or daughter lives abroad is not, by itself, a legal reason to remove a person\u2019s decision-making rights.<\/p>\n<p>The court must also apply the principle of necessity. Under <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038311088\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038311088\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 428 of the Civil Code<\/a>, a judicial measure is available only where less restrictive arrangements are insufficient, including a valid French <em>mandat de protection future<\/em> (future-protection mandate), ordinary powers of representation, or the legal assistance available between spouses. The same article requires the measure to be proportionate and individualised. The statute says: \u201c<q>La mesure est proportionn\u00e9e et individualis\u00e9e en fonction du degr\u00e9 d&#8217;alt\u00e9ration des facult\u00e9s personnelles de l&#8217;int\u00e9ress\u00e9.<\/q>\u201d That rule is important when a relative asks for a tutelle simply because managing a UK pension, a French bank account or a property is inconvenient.<\/p>\n<p><em>Curatelle<\/em> is normally considered where the person can still act but needs continuing assistance or supervision for important civil acts. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427481\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427481\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 440 of the Civil Code<\/a> describes the person who \u201c<q>a besoin d&#8217;\u00eatre assist\u00e9e ou contr\u00f4l\u00e9e d&#8217;une mani\u00e8re continue dans les actes importants de la vie civile<\/q>\u201d. A simple curatelle usually leaves everyday administration with the protected person while requiring the curateur, or curator, to assist with significant acts such as borrowing money, selling a substantial asset or accepting an inheritance. A reinforced curatelle can give the curator a role in receiving income and paying ordinary expenses. An arranged curatelle can adapt the list of acts to the person\u2019s actual abilities rather than applying a rigid package of restrictions.<\/p>\n<p><em>Tutelle<\/em> is more restrictive. It is intended where the person must be represented continuously in civil acts and neither a sauvegarde de justice nor a curatelle would provide sufficient protection. Representation does not mean that every aspect of life is handed to another person. The court\u2019s order should identify the powers that are necessary, and the protected person retains personal rights that the law treats as their own. A British pensioner who can decide where to live, what care to accept and whom to see should not be presented as incapable merely because a relative wants to control a bank account.<\/p>\n<p>The third option, <em>sauvegarde de justice<\/em>, is a lighter and generally temporary response. It can protect a person while a fuller application is being prepared or while the court assesses whether a curatelle or tutelle is needed. It may also allow certain transactions to be challenged if they were harmful to the person. It is not a substitute for an urgent medical or safeguarding response, but it can be useful where there is immediate financial risk and the evidence for a longer measure is still being assembled.<\/p>\n<p>Protection of the person must not be confused with total control of healthcare. Article 458 of the Civil Code excludes acts that require strictly personal consent from assistance or representation, subject to specific legislation. Under <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038310445\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038310445\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 459<\/a>, \u201c<q>la personne prot\u00e9g\u00e9e prend seule les d\u00e9cisions relatives \u00e0 sa personne dans la mesure o\u00f9 son \u00e9tat le permet<\/q>\u201d. The person responsible for protection must also provide information, adapted to the person\u2019s condition, about the situation, the usefulness and urgency of proposed acts, and the consequences of refusal; that duty appears in <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006428034\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006428034\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 457-1<\/a>.<\/p>\n<p>This matters in an English-speaking household. A curator or tutor does not automatically decide where a British pensioner lives, whether they receive ordinary medical treatment, whether they speak to relatives in the United Kingdom, or whether they keep their French or British identity documents. Article 459-2 provides that the protected person chooses their residence and maintains personal relationships, with the judge resolving difficulties. The wording is direct: \u201c<q>La personne prot\u00e9g\u00e9e choisit le lieu de sa r\u00e9sidence.<\/q>\u201d A proposed move to a care home, a return to Britain or a sale of a French home may require a separate analysis, evidence and, in some circumstances, judicial authorisation.<\/p>\n<p>Finally, the order does not erase existing civil rights. It creates a legal framework for assistance or representation. The scope should be tested against real tasks: opening correspondence, communicating with HMRC, receiving a State Pension, paying French tax, dealing with a bank, signing a care contract, managing a rental property, or making a succession-related decision. A precise application gives the judge a realistic alternative to an unnecessarily broad tutelle.<\/p>\n<h3>B. Does Brexit or a British passport prevent a French protection order?<\/h3>\n<p>No. Brexit changed immigration and social-security arrangements; it did not create a nationality bar to a French adult-protection application. A British citizen with a Withdrawal Agreement residence card, a long-stay visa or another lawful status remains a person who may be protected by the French courts if the French jurisdictional conditions are met. The card proves an immigration position. It does not authorise a child, spouse or attorney to operate the pensioner\u2019s account. Conversely, the absence of that card does not automatically decide whether an adult-protection judge has jurisdiction.<\/p>\n<p>The practical starting point is <em>r\u00e9sidence habituelle<\/em>, meaning habitual residence: the place where the person\u2019s life is genuinely centred, assessed from the facts rather than from a single document. <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000020031187\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000020031187\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1211 of the Code of Civil Procedure<\/a> identifies the territorially competent judge as the judge of the protected person\u2019s habitual residence or, in some circumstances, the tutor\u2019s domicile. A British pensioner who lives year-round in France, receives care there, uses French health services and treats a French address as their home will normally begin with the tribunal judiciaire serving that residence. A person who is only visiting France while remaining habitually resident in England, Wales, Northern Ireland or Scotland requires a more careful international-jurisdiction analysis.<\/p>\n<p>France and the United Kingdom also appear in the status materials for the 2000 Hague Convention on the International Protection of Adults. The <a href=\"https:\/\/www.hcch.net\/en\/instruments\/conventions\/status-table\/?cid=71\">HCCH status table<\/a> records the United Kingdom\u2019s position through Scotland, while the <a href=\"https:\/\/www.hcch.net\/en\/instruments\/conventions\/specialised-sections\/adults\">HCCH adult-protection materials<\/a> explain the Convention\u2019s purpose: avoiding conflicts over jurisdiction, applicable law, recognition and enforcement. That distinction should not be glossed over. The Convention\u2019s United Kingdom position is not a blanket answer for every British person connected with England, Wales, Northern Ireland or Scotland. The person\u2019s real residence and the part of the United Kingdom involved must be identified before relying on cross-border recognition.<\/p>\n<p>A UK family member can still be a serious candidate for appointment. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427589\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006427589\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 430<\/a> allows the application to be made by the person concerned, their spouse or civil partner, a parent or relative, someone with close and stable ties, an existing representative, or the public prosecutor. It does not say that the applicant must be French. But appointment is separate from the right to apply. The court will consider whether a relative in Britain can communicate reliably, understand the French order, maintain contact, deal with French institutions and account for financial decisions. Distance can be managed with appropriate arrangements; it should be addressed openly rather than hidden.<\/p>\n<p>Language is a practical issue, not a reason to assume incapacity. The judge must be able to hear the pensioner\u2019s own wishes. The family should request an interpreter or provide a clear language plan if French is not sufficiently understood. A medical report should distinguish a language barrier from a cognitive or physical impairment. Bank correspondence, pension statements, care invoices and UK documents should be organised in a way that lets the court see the problem without forcing the pensioner to sign documents they do not understand.<\/p>\n<p>The same <a href=\"https:\/\/kohenavocats.fr\/avocat-depot-garantie-paris\/\">caution<\/a> applies to a UK Lasting Power of Attorney, or LPA. An LPA is a British legal instrument whose scope depends on the law and registration system of the relevant UK jurisdiction. It should not be described as automatically equivalent to a French curatelle or tutelle. The French court may need to know whether an LPA exists, whether it was made while the person had capacity, what powers it grants, where it was registered and whether it can be recognised for the specific French act. An LPA may be part of the evidence that a French judicial measure is unnecessary, but it is not a shortcut to operating every French account or signing every French deed.<\/p>\n<p>Cross-border assets require an operational plan. The French judge can set a protective measure, but a UK bank, pension provider, insurer or public authority may ask for a certified copy of the order, proof that it is final, a translation, a new certificate or a separate recognition step. A French tutor should not promise a British institution that a French order will be accepted without checking the institution\u2019s process. The application should list the assets and institutions precisely: French current account, UK pension, ISA, house, rental income, tax account, care fees and regular liabilities. That makes the future representative\u2019s task manageable and reduces the risk of a vague order that nobody will implement.<\/p>\n<h2>II. How do you apply, choose the family member and challenge a refusal?<\/h2>\n<h3>A. What documents and steps are required before the judge decides?<\/h3>\n<p>The application is a <em>requ\u00eate<\/em>, meaning a formal written application to the court. The court does not open curatelle or tutelle because a relative sends an email saying that a pensioner is \u201cconfused\u201d. The application must connect medical facts to concrete risks, identify the requested measure and show why a less restrictive solution is not enough.<\/p>\n<p>The first document is the <em>certificat m\u00e9dical circonstanci\u00e9<\/em>, or detailed medical certificate. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038310450\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038310450\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 431 of the Civil Code<\/a> requires, on pain of inadmissibility, a detailed certificate prepared by a doctor chosen from a list established by the public prosecutor. The statutory wording refers to \u201c<q>un certificat circonstanci\u00e9 r\u00e9dig\u00e9 par un m\u00e9decin choisi sur une liste \u00e9tablie par le procureur de la R\u00e9publique<\/q>\u201d. The ordinary GP is not automatically the doctor who can prepare this certificate. The family should contact the tribunal or prosecutor\u2019s office for the current list in the relevant area and ask how the certificate must be delivered, usually in a sealed envelope for the court or prosecutor.<\/p>\n<p>The doctor\u2019s task is not to recommend a preferred relative. The report should describe the impairment, its foreseeable development, the person\u2019s ability to understand and express a choice, and the consequences for assistance or representation. Useful evidence may include a history of missed payments, scams, unsafe driving, repeated lost documents, unexplained transfers, inability to manage medication, or vulnerability during a hospital discharge. The evidence must remain respectful and proportionate. A family member should not manufacture a crisis by withholding information or arranging a consultation designed to produce a predetermined conclusion.<\/p>\n<p><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038810494\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038810494\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1218 of the Code of Civil Procedure<\/a> sets out the core contents of the application. The rule begins: \u201c<q>La requ\u00eate aux fins de prononc\u00e9 d&#8217;une mesure de protection d&#8217;un majeur comporte, \u00e0 peine d&#8217;irrecevabilit\u00e9<\/q>\u201d. It requires the detailed medical certificate, the identity of the person to be protected and an account of the facts that make protection necessary under the Civil Code. The current <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F2094\">Service-Public guidance on curatelle<\/a> also identifies the identity document, the facts, the application form and the civil-status information normally required.<\/p>\n<p>For a British pensioner, the document pack should normally be assembled in four sections:<\/p>\n<ul>\n<li><strong>Identity and civil status:<\/strong> a clear passport copy, the French residence document if one exists, the French birth-certificate information requested by the form, marriage or civil-partnership evidence, and the contact details of children, relatives or other people with close and stable ties.<\/li>\n<li><strong>Medical evidence:<\/strong> the sealed detailed certificate, relevant hospital or care information where lawfully available, the name of the treating doctor, and a short chronology of deterioration rather than a bundle of unexplained medical records.<\/li>\n<li><strong>Practical and financial evidence:<\/strong> French and UK bank details, pension providers, tax notices, property or tenancy information, care invoices, debts, insurance, regular income, recent suspicious transactions and any urgent risk to housing or healthcare.<\/li>\n<li><strong>Family and safeguards:<\/strong> the proposed curator or tutor, their relationship with the pensioner, residence and language arrangements, availability, any conflict of interest, and the reasons a French professional representative should be appointed if no family member can perform the role.<\/li>\n<\/ul>\n<p>British documents should be identified by their real function. A UK pension statement is evidence of income, not proof that the pensioner is resident in Britain. A council-tax bill or electoral document may help establish a historical address, but it does not establish present capacity. A letter from a UK relative can explain family support, while French utility bills, medical appointments, tax notices and care records may establish the person\u2019s habitual residence in France. When documents are in English, the court or another institution may require a French translation by an authorised translator. The application should not assume that an informal translation will be accepted for a birth certificate, power of attorney, bank document or medical record.<\/p>\n<p>The person\u2019s own wishes remain central. Under <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000030253955\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000030253955\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 432 of the Civil Code<\/a>, \u201c<q>Le juge statue, la personne entendue ou appel\u00e9e.<\/q>\u201d The person can be heard at the tribunal, at home or in another suitable place depending on the circumstances. The court may decide not to hold the hearing only for a reasoned medical reason, such as an inability to express a will or a risk to health, and the medical evidence must support that decision. A family should prepare the pensioner for the process without coaching their answers. The objective is to explain who will attend, what the judge may ask and how an interpreter can be used.<\/p>\n<p>The pensioner may have a lawyer. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006070716\/LEGISCTA000006149757\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006070716\/LEGISCTA000006149757\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1214 of the Code of Civil Procedure<\/a> provides for the choice of a lawyer and the possibility of asking the court to have the b\u00e2tonnier, the head of the local Bar, appoint one officially. The family should raise the language issue early. A bilingual relative can support communication where the judge permits it, but that relative is not automatically an interpreter and may have a conflict if they are seeking appointment or control of an asset.<\/p>\n<p>The application is sent or filed with the <em>greffe<\/em>, meaning the court registry, of the tribunal judiciaire for the pensioner\u2019s habitual residence. Keep proof of delivery and a copy of everything filed. If there is immediate danger, the family should say so clearly and contact the prosecutor, hospital safeguarding team, social services or emergency services as appropriate. A court application is not a substitute for immediate protection against violence, a medical emergency or an active financial scam.<\/p>\n<p>The judge then chooses the measure and the person responsible for it. Article 449 gives priority to a spouse, civil partner or cohabiting partner in the absence of a prior designation, then to a parent, relative, person living with the protected adult or person with close and stable ties. It also requires the judge to consider \u201c<q>les sentiments exprim\u00e9s par celui-ci, ses relations habituelles<\/q>\u201d. A British daughter living in Manchester may therefore be proposed, but the file should explain travel, communication, translations, banking, tax and supervision. If no relative or close person can perform the role, Article 450 allows the appointment of a professional <em>mandataire judiciaire \u00e0 la protection des majeurs<\/em>, meaning a judicial adult-protection representative. The applicable Civil Code provisions are set out in the <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGISCTA000006181866\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGISCTA000006181866\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">L\u00e9gifrance section on the curator and tutor<\/a>.<\/p>\n<p>The court can appoint a subrog\u00e9 curateur or subrog\u00e9 tuteur, meaning a supervisory substitute, where that safeguard is useful. It can also define whether the measure protects the person, their property or both. Article 452 reminds everyone that \u201c<q>La curatelle et la tutelle sont des charges personnelles.<\/q>\u201d The role cannot simply be delegated to an unaccountable friend, accountant or care worker. A representative may use permitted assistance, but remains responsible for the legal duties attached to the order.<\/p>\n<p>Duration should be planned from the start. Under <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000030253950\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000030253950\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 441 of the Civil Code<\/a>, the judge normally fixes a period that cannot exceed five years; a longer initial tutelle is possible only under the statutory conditions and with reasoned medical support. A renewal or adjustment is not automatic. <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000030253939\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000030253939\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 442<\/a> allows renewal, modification, replacement or termination, with a medical certificate and the procedural protections required by the case. Put the expiry date in the family calendar. The opinion concerned the position of a professional representative after a move between departments, not Brexit. Its value for a British family is practical: a change of address, a French care placement, a return trip to Britain or the disappearance of a local representative should be analysed through the pensioner\u2019s interests and the court\u2019s ability to supervise the measure, not through nationality stereotypes.<\/p>\n<p>An appeal file should be evidence-led.
