The immediate question is not simply whether the candidate has a student residence card. The company must identify the exact document, calculate the student\u2019s remaining annual salaried-work allowance, confirm whether the proposed role stays within the accessory-work route, notify the competent prefecture when required, and complete the ordinary French hiring sequence. The 964-hour figure is a legal ceiling for the standard student route, not a monthly quota and not a guarantee that a full-time job may begin. The employer\u2019s declaration to the prefecture is distinct from the DPAE, or d\u00e9claration pr\u00e9alable \u00e0 l\u2019embauche, which is the prior declaration of employment to the social-protection bodies. This guide is for a French SAS (soci\u00e9t\u00e9 par actions simplifi\u00e9e, a simplified joint-stock company), SARL (soci\u00e9t\u00e9 \u00e0 responsabilit\u00e9 limit\u00e9e, a private limited company), branch or subsidiary hiring directly. The practical issue is precise: can the company lawfully schedule this student, for these hours, in this role, before filing the DPAE?<\/p>\n<h2>I. Can a French company hire a non-EU student within the 964-hour limit?<\/h2>\n<h3>A. What does a student residence document authorize and how is the annual cap calculated?<\/h3>\n<p>The standard starting point is the wording of the student\u2019s immigration document. \u201cNon-EU\u201d is used here as shorthand for a person who is not a national of the European Union, the European Economic Area (EEA) or Switzerland, subject to nationality-specific agreements and special rules. A foreign-owned company should not classify a candidate only from a passport. It should read the residence card, the long-stay visa equivalent to a residence permit (VLS-TS, or visa de long s\u00e9jour valant titre de s\u00e9jour), the validity dates and any restrictions printed on the document. A card marked \u201c\u00e9tudiant\u201d is not interchangeable with a \u201csalari\u00e9\u201d, \u201ctravailleur temporaire\u201d, \u201ctalent\u201d or family-life document.<\/p>\n<p><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776689\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042776689\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 422-1 of the Code on the Entry and Residence of Foreigners and the Right of Asylum<\/a> (CESEDA, the Code de l&#8217;entr\u00e9e et du s\u00e9jour des \u00e9trangers et du droit d&#8217;asile) states: \u201cCette carte donne droit \u00e0 l&#8217;exercice, \u00e0 titre accessoire, d&#8217;une activit\u00e9 professionnelle salari\u00e9e dans la limite de 60 % de la dur\u00e9e de travail annuelle.\u201d The words \u201c\u00e0 titre accessoire\u201d matter. The student\u2019s studies remain the basis of the residence status. Salaried work is permitted as an accessory activity within the statutory limit; the card is not a general authorization for an unlimited full-time position.<\/p>\n<p>The current government guidance expresses the 60% ceiling as 964 hours per year for a standard student card or VLS-TS. The employer should use 964 hours as an operational control number, but should also preserve the legal basis and the date on which the calculation was made. The figure is not a promise that 964 hours remain available. The candidate may already have worked for another employer, held several jobs, worked under an earlier contract during the relevant annual period, or used hours that the company\u2019s payroll file does not know about. A signed declaration from the candidate is useful evidence, but it is not a substitute for checking the actual document and the applicable rules.<\/p>\n<p>The employer should calculate the proposed work over the relevant annual period, including the hours that the contract, schedule, mandatory training, onboarding and foreseeable overtime would require. A schedule of 18 hours per week can look safe when viewed only as a weekly figure, but 18 hours multiplied across a long period may exceed the annual ceiling. A part-time contract with irregular shifts requires a written forecast. If several employers are involved, the company should ask the candidate for the other employment periods and should not assume that each employer has a separate 964-hour allowance. The annual cap is a control on the student\u2019s permitted salaried activity, not a benefit created separately by every contract.<\/p>\n<p>The calculation should identify at least four dates: the document\u2019s validity period, the employment start date, the planned end date or review date, and the annual period used for the hour calculation. It should then identify the hours already worked or reserved under other contracts, the hours proposed by the French company, and the margin left for unavoidable changes. If a student has only a small margin, the company should not use the margin as a buffer for regular overtime. An hour-control sheet signed by the responsible manager and shared with payroll is more reliable than a note saying \u201cpart-time student\u201d.<\/p>\n<p>A student card does not remove ordinary employment-law rules. The company must still define the position, pay at least the applicable French minimum wage, known as the SMIC (salaire minimum interprofessionnel de croissance), apply the relevant collective agreement, respect working-time rules, provide required information and arrange occupational-health formalities. A foreign founder may be unfamiliar with the French distinction between an employee, an independent contractor and a trainee. A student card does not convert a controlled employment relationship into a freelance service. If the company directs the work, sets the schedule and integrates the person into the business, the contract and declarations must reflect the real relationship.<\/p>\n<p>The 964-hour route also does not mean that the candidate may perform any task from any location. The employer should record the French establishment, worksite, remote-work arrangement, reporting line and actual activity. A student who works from France for the French company is not in the same position as a student who performs an independent service from another country. Remote work can change tax, social-security, immigration and permanent-establishment questions. This article concerns a French employment relationship in France; it should not be used to decide where an employee working abroad is insured or taxed.<\/p>\n<p>The first practical answer is therefore conditional. A French company can generally employ a non-EU student in salaried work without requesting a separate work authorization when the student\u2019s qualifying document covers the activity and the work remains within the permitted annual limit. The employer must nevertheless complete the specific declaration required for a foreign student and all ordinary employment formalities. The company should treat the student route as a controlled exception to the ordinary work-permit process, not as an informal shortcut.<\/p>\n<p>The official <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F2713\">Service Public guide for a non-EU student working in France<\/a> separates several situations: ordinary salaried work, apprenticeship, professionalization, work that forms part of the course and special nationality cases. The result can differ when the candidate is Algerian, when the document is a mobility document, when the contract is an apprenticeship or when the activity is part of a regulated course. The employer should identify the route before promising a fixed first day.<\/p>\n<h3>B. When does the role, document, nationality or contract require a different route?<\/h3>\n<p>The first trigger for a different route is the proposed number of hours. When the employment would exceed 60% of the annual working-time limit, the employer must examine whether a work authorization is required and whether the role satisfies the conditions for that application. The student\u2019s card does not silently expand because the company needs a full-time employee. A company that wants a 35-hour week should compare the annual hours with the 964-hour ceiling before issuing a final schedule. If the position is genuinely full time, a change of residence status or another work-authorizing route may be more coherent than trying to fit a full-time job into a student card.<\/p>\n<p><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006072050\/LEGISCTA000018525798\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006072050\/LEGISCTA000018525798\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">The current L\u00e9gifrance section on work-authorization categories<\/a> identifies the student documents and distinguishes accessory salaried activity within 60% of annual working time from activity above that threshold. The employer should follow the current portal and prefecture instructions because the document category, course connection, contract type and nationality can affect the application. It should not copy the answer from a colleague\u2019s \u201cstudent job\u201d into a full-time recruitment file.<\/p>\n<p>The second trigger is the exact document. A VLS-TS student document, a temporary student card, a student mobility document and a receipt or provisional certificate do not necessarily have identical wording or scope. A renewal receipt may preserve some rights only if it is the document issued for that route and expressly has the required effect. An appointment confirmation, a payment receipt or a screenshot of an online account is not automatically a document authorizing salaried work. The company should ask for the document in force on the intended first day and record its exact wording without treating an application reference as a work permit.<\/p>\n<p>The third trigger is the candidate\u2019s nationality. The CESEDA route is not a universal answer for every country. Bilateral instruments, including the specific rules applicable to some Algerian nationals, can change the analysis of student work, status and authorization. The employer should not give a candidate a definitive answer from the label \u201cnon-EU\u201d. It should record nationality, document category and the legal route used, then check the current official guidance. Where a treaty or special category applies, the company should cite that route in its internal status memo and avoid mixing it with the ordinary CESEDA student rule.<\/p>\n<p>The fourth trigger is the contract. An apprenticeship contract or a professionalization contract can have a different authorization and validation path. The official guidance refers to validation by an OPCO, meaning op\u00e9rateur de comp\u00e9tences, for private-sector apprenticeship arrangements, or by the DREETS, the Direction r\u00e9gionale de l&#8217;\u00e9conomie, de l&#8217;emploi, du travail et des solidarit\u00e9s, for certain public-sector situations. An apprenticeship that is part of the course should not be treated as an ordinary part-time student job. The company should obtain the required validation before using any exemption or before setting the start date.<\/p>\n<p>The fifth trigger is a change of employer, role or work location. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049999770\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049999770\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 5221-1 of the Labour Code<\/a> provides that \u201cLa demande d&#8217;autorisation de travail est faite par l&#8217;employeur\u201d and that \u201cTout nouveau contrat de travail fait l&#8217;objet d&#8217;une demande d&#8217;autorisation de travail.\u201d The provision applies to the ordinary authorization route; it also reinforces the practical rule that a new French employer must not rely on an authorization granted for a different contract or treat a group transfer as automatically valid. A student exemption must be checked against the new contract, not assumed from the old employer\u2019s file.<\/p>\n<p>The sixth trigger is the distinction between a direct French hire and a posting by a foreign parent. If the foreign parent remains the employer and temporarily sends the worker to France, posting rules, the contractual chain and the French host\u2019s duties need a separate analysis. If the French subsidiary signs the employment contract, gives instructions and pays through French payroll, the subsidiary is normally the entity that must manage the employer-side file. The Kbis, which is the official extract of registered company information, does not prove that an individual student may work. The greffe, meaning the court registry office traditionally involved in commercial-register formalities, does not issue a residence or work authorization.<\/p>\n<p>A company should also ask whether its role is genuinely compatible with the student\u2019s status. A short research-assistant schedule, a weekend hospitality position or a limited office role can be assessed through hours, document and declaration. A role described as a permanent senior manager, a full-time product lead or the company\u2019s only operational employee creates a different risk profile. The job title is not decisive, but a mismatch between the student route and the actual responsibilities can prompt questions about the true activity, hours, salary, supervision and whether the company is trying to obtain a full-time employee without the proper route.<\/p>\n<p>Before the offer is signed, the foreign-owned company should prepare a route memo with the candidate\u2019s nationality, document type, document number, validity dates, work wording, remaining annual hours, job description, salary, work location, employer entity and contract type. It should state whether the employer will make the student declaration to the prefecture, whether a separate work authorization is required, and who will monitor the cap. The memo should include a warning that a DPAE receipt does not cure a missing immigration condition. If the route cannot be stated clearly, the start date should remain conditional.<\/p>\n<h2>II. How should the employer secure the student\u2019s first working day?<\/h2>\n<h3>A. What must the company check, declare and document before the DPAE?<\/h3>\n<p>The company should begin with a document matrix rather than with the payroll form. The matrix should place the candidate\u2019s identity, nationality, current residence document, document validity, permitted activity, annual hours already used, proposed hours and French worksite in separate fields. The employer entity should be identified by its legal name, SIREN and establishment SIRET. SIREN is the enterprise\u2019s unique nine-digit identifier; SIRET identifies a particular establishment. The company should use the same details on the offer, contract, student declaration, DPAE, payroll setup and internal approval.<\/p>\n<p>The employer should inspect the original document or a reliable secure copy and check whether it is still valid for the proposed first day. It should read the work wording instead of relying on an online translation. If the document is a VLS-TS, the company should confirm the validation and the dates that make it usable. If it is a renewal receipt or provisional document, the company should confirm that it expressly preserves the right to perform the proposed salaried activity. A document that allows limited work, one employer, one occupation or one location should not be recorded as an unrestricted right.<\/p>\n<p>The company must then make the specific foreign-student declaration to the prefecture when the student route requires it. The Service Public guidance currently describes a nominative declaration to the prefecture at least two working days before the effective hiring date. This is an immigration-administration step. It is not the DPAE and it should not be replaced with an email to an accountant, a payroll upload or a notification to the candidate\u2019s university. The company should save the date and time of the declaration, the submitted identity and contract information, the recipient or portal confirmation and any answer received.<\/p>\n<p>The employer\u2019s verification duty is also distinct. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000018766932\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000018766932\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 5221-8 of the Labour Code<\/a> states that \u201cL&#8217;employeur s&#8217;assure aupr\u00e8s des administrations territorialement comp\u00e9tentes de l&#8217;existence du titre\u201d. The current Service Public guidance explains that the authenticity check is normally requested from the prefecture of the place of employment at least two working days before the effective hiring date, with the stated exception for a person registered as a job seeker with France Travail. A student declaration and an authenticity request should be recorded separately because they answer different administrative questions.<\/p>\n<p>Next comes the DPAE. DPAE means d\u00e9claration pr\u00e9alable \u00e0 l\u2019embauche, or prior declaration of employment. It is the employer\u2019s nominative declaration to the relevant social-protection bodies before hiring. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006900849\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006900849\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 1221-10 of the Labour Code<\/a> provides: \u201cL&#8217;embauche d&#8217;un salari\u00e9 ne peut intervenir qu&#8217;apr\u00e8s d\u00e9claration nominative\u201d. The DPAE identifies the employment relationship for social administration; it does not validate the student\u2019s immigration status, increase the annual work-hour ceiling or replace the prefecture declaration.<\/p>\n<p>The DPAE has its own timing. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000024214323\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000024214323\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 1221-4 of the Labour Code<\/a> states that the declaration is sent \u201cau plus t\u00f4t dans les huit jours pr\u00e9c\u00e9dant la date pr\u00e9visible de l&#8217;embauche\u201d. The company should plan backwards from the actual first working date, not from the day the student showed a residence card. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000053220410\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000053220410\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 1221-5 of the Labour Code<\/a> states: \u201cLa d\u00e9claration pr\u00e9alable \u00e0 l&#8217;embauche est effectu\u00e9e par voie \u00e9lectronique.\u201d The electronic confirmation should be preserved with the immigration file and payroll instructions.<\/p>\n<p>The company must ensure that the DPAE data is internally consistent. It should check the legal name of the employer, the establishment address, the SIRET, the student\u2019s identity, the intended start date, the employment category and the information requested by the form. A foreign parent\u2019s bank account or an overseas payroll provider does not prove that the French employer completed the DPAE. If a payroll provider submits it, the engagement letter should identify who prepared, approved and retained the declaration and who will correct an error.<\/p>\n<p>The student should be entered in the RUP, the registre unique du personnel, or single personnel register. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033971569\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033971569\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 1221-13 of the Labour Code<\/a> states: \u201cUn registre unique du personnel est tenu dans tout \u00e9tablissement\u201d. The entry should be made at hiring and maintained in the required form. The RUP does not authorize work, but it should correspond to the contract, DPAE, payroll and actual start date. The company should not backdate the entry to hide a late declaration or a period in which the student worked without a document covering the activity.<\/p>\n<p>After the DPAE, the ordinary onboarding sequence continues. The company should give the employee the required written information, provide the contract and applicable collective-agreement information, arrange the occupational-health process, set up payroll and submit the DSN. DSN means d\u00e9claration sociale nominative, the monthly nominative social declaration used for French social administration. URSSAF means Unions de recouvrement des cotisations de s\u00e9curit\u00e9 sociale et d\u2019allocations familiales, the organization most employers encounter for the recovery of social-security and family-benefit contributions. These systems are not immigration systems. Their successful activation cannot cure a student-hour overrun.<\/p>\n<p>The corporate file should also be readable to an administration or inspector. The INPI, Institut national de la propri\u00e9t\u00e9 industrielle, operates the Guichet unique, the online business-formality portal. The <a href=\"https:\/\/formalites.entreprises.gouv.fr\/identite_entreprise.php\">INPI guidance on company identity<\/a> explains the business identifiers used in French formalities. The RNE is the Registre national des entreprises, or National Register of Enterprises, and the RCS is the Registre du commerce et des soci\u00e9t\u00e9s, or Trade and Companies Register, where applicable. The BODACC is the Bulletin officiel des annonces civiles et commerciales, the official bulletin publishing certain civil and commercial announcements. None of these corporate records proves that the student may work more than the immigration document allows.<\/p>\n<p>Data protection matters as well. The employer should keep enough evidence to prove the right-to-work decision and the hour calculation, but it should not collect unrelated academic, family or medical information. Access should be limited to the director, HR contact, payroll provider and advisers who need it. A foreign founder may keep files in a group system outside France; the company should still control access, retention and transmission under the applicable data-protection rules. The goal is a defensible employment file, not an uncontrolled copy of the student\u2019s personal history.<\/p>\n<p>A safe release decision should be signed or approved before the first working hour. It should state: the document reviewed, the route used, the annual hours available and reserved, the prefecture declaration date, the authenticity-check evidence, the DPAE receipt, the RUP instruction, the payroll owner and the next expiry or review date. If any item is missing, the manager should not ask the student to \u201cstart informally\u201d while the file is completed. A productive task, customer call, internal deliverable or system access for real work is still work even if the company calls it orientation.<\/p>\n<h3>B. What happens if the student exceeds the cap or the employer uses the wrong route?<\/h3>\n<p>The central failure is not an incorrectly typed job title; it is allowing the student to perform salaried work outside the document\u2019s legal scope. A company that schedules hours above the annual ceiling, ignores hours worked for another employer, or continues after document expiry can create an unauthorized-employment problem. The company should monitor the cap during the relationship, not only when the contract is signed. A monthly payroll report should compare planned, worked and remaining hours and should trigger an escalation before the limit is reached.<\/p>\n<p><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000024197709\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000024197709\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 8251-1 of the Labour Code<\/a> states: \u201cNul ne peut, directement ou indirectement, embaucher, conserver \u00e0 son service ou employer\u201d. It also covers employment outside the professional category, occupation or geographical area authorized by the relevant title. Paying through a foreign parent, calling the work an internship, using a contractor invoice or moving the student to an unlisted site does not automatically solve the problem. The actual work, control and document scope must be compared.<\/p>\n<p>The criminal risk is not theoretical. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032171290\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032171290\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 8256-2 of the Labour Code<\/a> provides for five years\u2019 imprisonment and a fine of \u20ac30,000 for employing an unauthorized foreign national, with the fine applied for each foreign national concerned and higher penalties for an organized group. The statutory protection for an employer confronted with a fraudulent title depends on the employer having made the social declarations and the required administrative verification without participating in or knowing of the fraud. It is a reason to keep evidence, not a reason to skip the student declaration or the DPAE.<\/p>\n<p>The student also retains employment rights if the employer used the wrong route. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032171278\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032171278\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 8252-2 of the Labour Code<\/a> begins: \u201cLe salari\u00e9 \u00e9tranger a droit au titre de la p\u00e9riode d&#8217;emploi illicite\u201d. The employee may claim salary and related benefits and, when the relationship is terminated, the statutory indemnity described by the article, subject to the applicable rules and any more favorable result. Stopping the schedule does not erase the hours already worked. The company should obtain advice before treating a correction as a simple payroll deletion.<\/p>\n<p>The Cour de cassation has treated the prohibition as a public-policy rule. The decision is fact-specific and does not remove the need for a lawful termination process. Its value for a student-hire file is the warning that an employer cannot treat the right-to-work condition as an optional administrative detail.<\/p>\n<p>In <a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000037320025\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000037320025\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Cass. crim., 8 August 2018, no. 17-84.920<\/a>, the criminal chamber approved the finding that a manager \u201cse devait de v\u00e9rifier la situation du salari\u00e9 \u00e9tranger qu&#8217;il souhaitait embaucher\u201d. The evidence included a mismatch between the worker and the identity photograph and the failure to request original documents in circumstances that created doubt. For a student, the warning extends beyond identity: the employer should compare the person, the document, the student category, the annual hours and the actual job, and should investigate an inconsistency before allowing work.<\/p>\n<p>The opposite limit is also important. In <a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000028642376\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000028642376\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Cass. soc., 18 February 2014, no. 12-19.214<\/a>, the Cour de cassation upheld the conclusion that \u201cen pr\u00e9sence d&#8217;un titre en apparence r\u00e9gulier, il n&#8217;\u00e9tait tenu \u00e0 aucune v\u00e9rification particuli\u00e8re\u201d where the employer had no serious, objective reason to doubt the document and had acted consistently when a fraud later appeared. That protection is fact-specific. It does not excuse the current student declaration, the DPAE, the annual-hour calculation or the response to a document that visibly restricts the proposed work.<\/p>\n<p>In <a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000032536362\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000032536362\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Cass. crim., 10 May 2016, no. 15-82.050<\/a>, the judgment restated the prohibition against employing an unauthorized foreign national \u201cdirectement ou par personne interpos\u00e9e\u201d while examining its interaction with concealed work. This matters when a foreign group pays the student through a parent or an intermediary while the French company directs the activity. The group should identify the true employer, the true payer, the entity making the DPAE and the entity supervising the work. Payment architecture cannot replace legal classification.<\/p>\n<p>In <a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000038427273\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000038427273\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Cass. soc., 17 April 2019, no. 18-15.321<\/a>, the Court held that \u201cun \u00e9tranger non muni du titre l&#8217;autorisant \u00e0 exercer une activit\u00e9 salari\u00e9e en France n&#8217;est pas assimil\u00e9 \u00e0 un salari\u00e9 r\u00e9guli\u00e8rement engag\u00e9\u201d for the rules governing a transfer to an incoming service provider. The case concerned a different contractual setting, but it is a useful group-control lesson. A student\u2019s move from a foreign parent, an internship provider or another company to the French subsidiary requires a fresh comparison of employer, document, role, hours and declaration. An old file should not be copied as if the new contract were automatically covered.<\/p>\n<p>If the hour cap is approaching, the company should stop treating it as a theoretical number. It should freeze additional shifts, reconcile payroll with actual attendance, request the student\u2019s current employment history, check whether hours were recorded under another contract, and decide whether to reduce the schedule or apply for the authorization required for a different route. The company should not solve an overrun by deleting hours, changing the contract date or asking the student to work without pay. If the business needs a full-time employee, it should analyze the appropriate status change rather than make the student card carry a role it was not designed to support.<\/p>\n<p>If the document is about to expire, the company should identify the replacement document before the next shift. A renewal application, appointment confirmation or email from a university does not automatically extend the right to work. The employer should read the exact wording of the renewal receipt, extension certificate or new card and check whether it covers the same employer, job, hours and location. Where the document is unclear, the company should suspend productive work until the competent administration or qualified adviser confirms the legal position. The DPAE remains a separate social declaration and does not extend immigration rights.<\/p>\n<p>If the company has filed the wrong declaration or filed it late, it should create a correction chronology. The chronology should record the intended start date, the actual hours worked, the document held, the prefecture declaration, the DPAE submission, the payroll entries and the date the error was discovered. The company should notify the payroll provider, correct the social records through the available official process and assess immigration, employment and criminal exposure. It should not backdate a declaration or manufacture a document. A transparent correction file is more credible than a sequence designed to make the first day disappear.<\/p>\n<p>The foreign-labour employer tax also deserves a separate check. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000046872799\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000046872799\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 436-10 of the CESEDA<\/a> states: \u201cLe redevable est l&#8217;employeur qui embauche le travailleur \u00e9tranger\u201d. The tax on the first admission to stay for salaried work can depend on the worker\u2019s status, contract duration and exemption. A student route may produce a different result from a standard first admission, so the company should not assume either that the tax is always due or that the student label always exempts it. The <a href=\"https:\/\/www.impots.gouv.fr\/taxe-due-par-les-employeurs-de-main-doeuvre-etrangere\">impots.gouv.fr guidance on the foreign-labour employer tax<\/a> should be checked with the contract and status facts.<\/p>\n<p>A short scenario test can expose the difference between lawful and unsafe planning:<\/p>\n<ol>\n<li>A student holds a qualifying document, has no other salaried work, and is scheduled for 12 hours a week for a limited period. The company still checks the document, confirms the remaining annual allowance, makes the student declaration when required, files the DPAE in its legal window and monitors the hours.<\/li>\n<li>A student is scheduled for 20 hours a week over a full year. The company must calculate the annual total rather than assume that \u201cpart time\u201d is enough. If the total exceeds 964 hours, it must reduce the schedule or analyze the work-authorization route before the first day.<\/li>\n<li>A student already works for another employer. The French company obtains the dates and hours needed to assess the shared annual ceiling and sets a monthly control. It does not treat its own contract as a separate allowance.<\/li>\n<li>A student\u2019s course includes an apprenticeship. The company checks the apprenticeship validation and the applicable exemption or authorization route instead of using the ordinary student-job declaration as a substitute.<\/li>\n<li>A student document expires during the planned employment. The company identifies a current work-authorizing document before the next shift and does not rely only on a renewal filing receipt.<\/li>\n<\/ol>\n<p>The final employer checklist should be completed before releasing the first shift:<\/p>\n<ol>\n<li>Identify the candidate\u2019s nationality and apply any treaty or special nationality rule before relying on the ordinary CESEDA student route.<\/li>\n<li>Read the exact student card, VLS-TS, mobility document or qualifying receipt and record validity dates and work wording.<\/li>\n<li>Calculate the 964-hour annual ceiling, including hours already worked or reserved for other employers.<\/li>\n<li>Compare the proposed role, location, schedule, salary and contract type with the student route.<\/li>\n<li>Decide whether the work stays within accessory activity or requires a separate work authorization or status route.<\/li>\n<li>Complete the student declaration to the prefecture at least two working days before the effective hiring date when the official route requires it.<\/li>\n<li>Request or preserve the employer\u2019s administrative verification of the document where the rule applies.<\/li>\n<li>File the DPAE no earlier than the permitted window and before hiring, then preserve the electronic receipt.<\/li>\n<li>Complete the RUP entry, contract information, occupational-health process, payroll setup, DSN and URSSAF steps.<\/li>\n<li>Assign an owner for monthly hour monitoring and document renewal, employer change and role-change alerts.<\/li>\n<li>Review the foreign-labour employer-tax position separately and retain the calculation or exemption analysis.<\/li>\n<\/ol>\n<p>The company should keep a one-page release record after each review. It should say who checked the document, which source was used, how many hours were available, what number of hours was scheduled, which declaration was filed, when the next review will occur and what event would trigger a stop. That record is particularly valuable for a foreign founder who is not in France every week. A director abroad, a payroll provider and a French manager can each have a different view of the first day unless one controlled record defines the legal gates.<\/p>\n<p>The key distinction is between a document that permits limited accessory work and a job that the company wants to fill without limitation. A student can be a valuable first French employee, but the company must respect the student purpose, annual ceiling, document wording and declaration sequence. If the business needs the person full time, changes the employer or changes the activity materially, it should choose the immigration and employment route that matches the facts. The cost of a correct route is easier to manage than a later dispute about unauthorized hours, unpaid salary, social declarations or the true employer.<\/p>\n<h2>Conclusion<\/h2>\n<p>A French company may generally hire a non-EU student for accessory salaried work within the statutory 60% limit, expressed in current official guidance as 964 hours per year, when the student holds the qualifying document and no special nationality or contract rule changes the route. The employer must calculate the remaining allowance, verify the exact document and its scope, make the foreign-student declaration to the prefecture when required, complete the DPAE separately, enter the student in the RUP and operate ordinary payroll and social declarations. The 964-hour ceiling is not a monthly quota, a separate allowance for every employer or a substitute for a work authorization when the role exceeds the student route.
