The short answer is that the documents do not have the same legal function. A GHIC is designed for medically necessary state treatment during a temporary stay. A UK S1 can establish that the United Kingdom is responsible for a person\u2019s state healthcare costs, but eligibility, issue, validity and registration must be demonstrated. Neither document automatically proves every condition of a French long-stay visitor application.<\/p>\n<p>For a stay of more than three months, the French authority assesses the proposed immigration route, resources, accommodation, intention not to work in France and health cover as a whole. The key question is not whether the applicant owns a card, but whether the file proves continuous and credible cover for the proposed residence. A British pensioner with a properly issued S1 may have a defensible evidence strategy; an applicant with only a GHIC or a pending S1 request normally has a gap that needs to be addressed. A private policy may be necessary for that gap, even where state-funded cover is expected later.<\/p>\n<p>This distinction matters because the visa stage and the post-arrival French healthcare stage are different. A visa does not become lawful merely because a CPAM, the local office of the French health-insurance fund, might register the applicant in the future. Can a UK S1 or GHIC satisfy the French visitor visa health-insurance requirement?<\/h2>\n<h3>A. What is the legal test for a British applicant after Brexit?<\/h3>\n<p>The first step is to identify the immigration status that the applicant is actually seeking. A British national who was already living in France and covered by the EU\u2013UK Withdrawal Agreement may have a protected residence route. That person should not automatically apply as a new visitor. The fact that the applicant is British does not restore the former freedom to settle for an unlimited period. The precise route can change for a dual national, a family member of an eligible protected resident, a worker, a student or a person covered by a separate international arrangement.<\/p>\n<p>The threshold for a stay above three months appears in <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562134\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562134\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L312-2 of the Code of Entry and Residence of Foreigners and the Right of Asylum (CESEDA)<\/a>. CESEDA is the French immigration code. Its wording begins: <q>Tout \u00e9tranger souhaitant entrer en France en vue d&#8217;y s\u00e9journer pour une dur\u00e9e sup\u00e9rieure \u00e0 trois mois doit solliciter aupr\u00e8s des autorit\u00e9s diplomatiques et consulaires fran\u00e7aises un visa de long s\u00e9jour<\/q>. In English, a person who wants to enter France to stay for more than three months must request a long-stay visa from the French diplomatic or consular authorities. The same article lists a visitor stay among the possible purposes of that visa and limits its validity to one year.<\/p>\n<p><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562113\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051562113\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L411-1 CESEDA<\/a> then requires an adult foreign national who wants to stay in France for more than three months to hold one of the specified residence documents, including a long-stay visa or a residence card. This is why an applicant should not treat a GHIC as a residence document. It concerns healthcare access, not permission to enter or settle. It also explains why a pending CPAM registration cannot, by itself, repair a visa file that has not yet proved the right to reside.<\/p>\n<p>The visitor conditions are set out in <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000042776442\/2023-04-08\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000042776442\/2023-04-08\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L426-20 CESEDA<\/a>. The provision requires evidence that the applicant can live from personal resources, an undertaking not to carry out professional activity in France, and health insurance covering the period of residence. The official wording on cover is: <q>Il doit en outre justifier de la possession d&#8217;une assurance maladie couvrant la dur\u00e9e de son s\u00e9jour<\/q>. This means \u201cthe applicant must also prove possession of health insurance covering the duration of the stay\u201d. The provision does not say that a GHIC is enough, and it does not create an automatic exemption for a British applicant who expects to qualify for French state healthcare later.<\/p>\n<p>The statute does not reduce the visitor assessment to an insurance certificate. The applicant must also show that the visitor route fits the real purpose of the proposed residence and that the resources are sufficient. The French administration may ask why the person needs to remain for more than three months, how accommodation will be financed, and how the applicant will avoid working in France. A health document that is technically valid cannot cure an inconsistent purpose statement or an unexplained financial plan.<\/p>\n<p>This point is important for British pensioners. A UK State Pension may explain why an S1 could be available, but the pension itself must be presented as part of the resources evidence, not as a substitute for all other requirements. Include the pension award or payment evidence, bank statements showing receipt, a realistic French budget and proof that the visitor will not carry out work prohibited by the chosen status. If the pension is paid in sterling, explain the exchange-rate method used in the budget and identify any regular deductions.<\/p>\n<p>The French authorities also distinguish a short-stay insurance question from the long-stay visitor question. France-Visas describes a \u20ac30,000 minimum for certain short stays and emergency treatment or repatriation cover. That figure should not simply be copied into a long-stay visitor file as if it were the complete legal test. For a visitor residence, the safer analysis is whether the proposed evidence covers the whole period and responds to the wording of Article L426-20. The applicant should read the exact France-Visas instructions generated for the chosen nationality, purpose and duration.<\/p>\n<p>The post-Brexit context adds another possible mistake. The UK government\u2019s <a href=\"https:\/\/www.gov.uk\/guidance\/living-in-france\">Living in France guidance<\/a> separates people who were living in France before 1 January 2021 from people who are moving under the later rules. It directs a person to check the French visa or residence permit required before travelling. A British citizen should therefore establish the residence route first, then decide what health document supports it. Starting with an insurance product and working backwards can produce an application that is well insured but legally misclassified.<\/p>\n<p>The legal answer is therefore conditional. An S1 may be relevant evidence of state-funded healthcare responsibility. It is not a universal visa waiver. A GHIC is normally evidence for temporary, medically necessary treatment and is not a residence entitlement. A private policy may provide the clearest proof where the S1 is not yet issued, not valid from the planned arrival date, limited to another category of person, or incapable of answering the authority\u2019s questions about continuous cover.<\/p>\n<h3>B. Why is an S1 different from a GHIC and a private policy?<\/h3>\n<p>An S1 is a healthcare entitlement certificate issued by the responsible state. For a British person, it may be available where the United Kingdom remains responsible for healthcare costs, such as for a person receiving a UK State Pension or a qualifying exportable benefit, an eligible frontier worker, a posted worker or certain dependants. The exact entitlement depends on the facts and the applicable coordination rules. The applicant should obtain the certificate from the competent UK service rather than assume that a National Insurance record or a pension payment automatically produces an S1.<\/p>\n<p>The practical value of an S1 comes from its connection to a named person, a responsible state and a period of entitlement. The document should make it possible to identify the holder, the issuing authority and the date from which the United Kingdom accepts responsibility. If the certificate is issued only after arrival, it may not demonstrate cover at the time of the visa application or on the date the applicant plans to enter France. If registration with the French health-insurance system is required, the file should explain whether that registration has occurred, is possible only after arrival, or is still pending.<\/p>\n<p>The UK government\u2019s <a href=\"https:\/\/www.gov.uk\/guidance\/healthcare-in-france-including-martinique-and-guadaloupe\">healthcare guidance for UK nationals living in France<\/a> states that an S1 must be registered with the local CPAM office and explains that the holder can then receive French healthcare on the same basis as a French citizen, subject to patient contributions. It also distinguishes this arrangement from temporary use of a GHIC or an EHIC, the European Health Insurance Card. That guidance is useful for the UK side of the evidence, but the French visa authority still applies the French immigration test.<\/p>\n<p>A GHIC has a narrower function. It can give a person access to medically necessary, state-provided healthcare during a temporary stay, under the applicable rules. It does not normally cover private treatment, planned treatment, medical repatriation, changes to travel arrangements or every cost that a comprehensive long-stay policy might cover. The UK government expressly warns that a GHIC is not an alternative to travel insurance. A plastic card or card number therefore leaves several questions unanswered for a French visitor application: who pays for repatriation, what happens outside state providers, what exclusions apply, and how is coverage maintained during a full residence?<\/p>\n<p>A private policy is different again. It is contractual cover provided by an insurer, and its evidential strength depends on the wording rather than the product name. The certificate should identify the applicant exactly as in the passport, show France within the territorial scope, state the start and end dates, describe medical and hospital cover, explain emergency assistance and repatriation, and state significant exclusions. The applicant should include proof of payment and the insurer\u2019s confirmation that the policy is active. It is a reminder that an authority will examine the substance of the evidence. A fully documented S1 with a clear period of responsibility may be more meaningful than a generic insurance certificate. Conversely, a pending S1 application may be weaker than a paid private policy that clearly starts on the intended arrival date and lasts through the requested stay. The correct answer depends on the document trail, not the label on the front page.<\/p>\n<p>The distinction continues after arrival. A person who holds a valid visitor residence document may later interact with the French health-insurance system under a different set of rules. A French court decision found in the Judilibre research during this preparation illustrates the danger of mixing the stages. In Tribunal judiciaire de Paris, 31 May 2024, no. 21\/00198, the court described the holder of a visitor card as meeting the regular-stay condition for the social-security issue before it. Its wording refers to the holder who <q>remplit les conditions de s\u00e9jour r\u00e9gulier au sens de ces dispositions<\/q>. The official decision is available at <a href=\"https:\/\/www.courdecassation.fr\/decision\/67193e8714868318089f1003\">Cour de cassation, no. 21\/00198<\/a>.<\/p>\n<p>That judgment concerned a post-arrival social-security contribution dispute, not the grant of a long-stay visa. It does not say that a GHIC satisfies Article L426-20 or that a pending S1 guarantees a visa. It is useful only for the boundary: regular residence and healthcare registration are questions that arise after the immigration document exists. A British applicant should not argue that a future CPAM decision makes the current visa evidence complete.<\/p>\n<p>There is also a risk in relying on the word \u201cinsurance\u201d without testing the policy. A certificate may be headed \u201ctravel insurance\u201d while limiting each stay to 90 consecutive days. It may cover only emergency hospital treatment, exclude pre-existing conditions, start after the proposed entry date, or stop before the end of the requested residence. The applicant should read the schedule, exclusions and assistance conditions, and ask the insurer for a letter answering the specific French requirement. A broker\u2019s informal email is weaker than the policy and a formal certificate issued for the named applicant.<\/p>\n<p>For an S1-based application, the same discipline applies. Attach the S1, the UK letter confirming the entitlement that generated it, evidence of the effective date, and a short explanation of the French registration process. If the S1 is conditional on a benefit that may stop, explain the condition. If a dependant\u2019s cover is separate from the pensioner\u2019s, provide separate proof for each family member. If the certificate will not be available until after the visa decision, identify that fact and consider a private policy for the interim rather than presenting an expectation as an existing right.<\/p>\n<p>Finally, neither an S1 nor a GHIC permits work in France under a visitor route. The applicant should not describe a UK employment relationship, freelance activity or remote work in a way that contradicts the no-work undertaking. A health document does not transform a visitor application into a work application. If the real plan involves working, the safer course is to assess the work route and its tax and social-security consequences instead of using health cover to support the wrong immigration category.<\/p>\n<h2>II. How should a British applicant prove cover and challenge a refusal?<\/h2>\n<h3>A. Which evidence and timeline make the case credible?<\/h3>\n<p>The strongest file is organised around the date line. Set out the planned date of entry, the date on which the long-stay visa would begin, the requested end date, the date on which the S1 was issued or is expected, the date of any French registration, and the expiry of every private policy. Draw attention to any gap instead of leaving the decision-maker to discover it. A simple one-page chronology can prevent an otherwise valid document from appearing incomplete.<\/p>\n<p>The first evidence bundle should establish the immigration route:<\/p>\n<ul>\n<li>the British passport and evidence of any second nationality;<\/li>\n<li>proof of pre-2021 residence and a Withdrawal Agreement residence document if the protected route may apply;<\/li>\n<li>the France-Visas application confirmation and the selected purpose of stay;<\/li>\n<li>a signed statement that the applicant will not carry out professional activity in France where the visitor route requires that undertaking; and<\/li>\n<li>a clear explanation of why the proposed stay is genuinely longer than a series of short visits.<\/li>\n<\/ul>\n<p>The second bundle should establish healthcare responsibility. For an S1 applicant, include the original or official electronic certificate, the applicant\u2019s full name and date of birth, the issuing body, the effective date, any end date or condition, and the evidence of the qualifying UK State Pension, exportable benefit, posted-worker status, frontier-worker status or dependant relationship. Add the CPAM registration confirmation if registration has already occurred. If it has not, explain the expected process and attach the official UK guidance that describes registration after arrival. The file should say explicitly what covers the period before French registration.<\/p>\n<p>For an applicant using a private policy, the insurance bundle should contain the policy schedule, certificate, terms that describe medical and hospital treatment, emergency assistance, repatriation and death-related expenses, territorial scope, dates, exclusions, maximums and payment evidence. Ask the insurer to confirm in writing whether the policy covers the entire requested stay or only the first 90 days. If the certificate uses an annual renewal clause, obtain proof that the renewal is guaranteed or explain how uninterrupted cover will be maintained. A plan to renew later is not as strong as current cover for the complete period.<\/p>\n<p>For a combined S1 and private-policy strategy, label the responsibilities precisely. For example, a policy might cover the journey and the first period before S1 registration, while the S1 supports state healthcare responsibility from a later date. The covering letter should not describe the two documents as interchangeable. It should provide a calendar showing that every day of the intended stay has a documented source of cover. If the S1 is rejected, delayed or limited, the applicant should know what the fallback is before filing the application.<\/p>\n<p>The third bundle concerns resources. Include the UK State Pension statement, recent bank statements, other pension or investment income, regular expenses, tax evidence where relevant, and a budget for French accommodation, food, transport, utilities, healthcare contributions and insurance premiums. The figures should be consistent with the applicant\u2019s declared source of funds. A sudden transfer from a relative should be explained. If a family member will provide accommodation or financial support, include that person\u2019s identity, income, address and signed commitment, together with evidence of capacity to provide the support.<\/p>\n<p>The fourth bundle concerns the purpose and necessity of the stay. A visitor applicant should explain the proposed life in France: where the person will live, why the stay needs to exceed three months, how the person will spend the time without working, and why the selected route fits better than a short-stay visa or a work route. The explanation should not claim a future French job, regular business activity or an intention to use the visitor route as a bridge to a different status. If the applicant has a spouse, children or medical needs in France, explain the facts without suggesting a category that the evidence does not support.<\/p>\n<p>French administrative courts have recently shown why the evidence must address the whole file. In <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000053095706\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000053095706\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Nantes, 19 December 2025, no. 24NT02466<\/a>, the court examined a visitor application where the first certificate was <q>valable uniquement pour une dur\u00e9e maximale de s\u00e9jour ne d\u00e9passant pas 90 jours cons\u00e9cutifs<\/q>, although the requested stay was longer. The applicant later produced a new medical-insurance certificate covering 367 days before the Commission of Appeal against Visa Refusals considered the case. The court held that rejecting the appeal on the ground that cover was not adequate and valid involved an error of assessment. This does not guarantee success in another case, but it shows why a precise duration comparison can matter.<\/p>\n<p>The same decision also shows why a new document should be put before the competent appeal body in a traceable way. Keep the certificate, delivery proof, copy of the appeal, and any acknowledgement. An applicant who has corrected the insurance defect should be able to demonstrate exactly when the correction was submitted and to whom. A later policy that never reaches the authority cannot help the legal assessment of the refusal.<\/p>\n<p>The decision-making body must give reasons. <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000031367505\/2025-12-22\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000031367505\/2025-12-22\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L211-2 of the Code of Relations between the Public and the Administration<\/a> provides that a person has the right to be informed of the reasons for an adverse individual administrative decision and includes decisions refusing an authorisation. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031367513\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031367513\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L211-5 of the same code<\/a> adds: <q>La motivation exig\u00e9e par le pr\u00e9sent chapitre doit \u00eatre \u00e9crite et comporter l&#8217;\u00e9nonc\u00e9 des consid\u00e9rations de droit et de fait qui constituent le fondement de la d\u00e9cision<\/q>. In English, the reasons must be written and state the legal and factual considerations forming the basis of the decision.<\/p>\n<p>Read the refusal literally. If it says \u201cinadequate and valid health insurance\u201d, check duration, territory, person insured, exclusions, payment and the distinction between state entitlement and contractual cover. If it refers to resources, purpose, accommodation or a risk that the visitor route is being misused, prepare evidence for those points as well. Do not send only a new policy if the refusal contains several independent reasons. The appeal should answer each reason in the same order as the notification.<\/p>\n<p>A recent case makes this warning concrete. In <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000052821425\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000052821425\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Nantes, 21 November 2025, no. 24NT03374<\/a>, the court recorded that the administration had relied on inadequate health insurance and a risk of misuse of the visa. The court said that the initial insurance and misuse grounds were unlawful, but it nevertheless accepted a different reason concerning the applicant\u2019s failure to establish the need to stay in France for more than three months. The judgment states that the visitor\u2019s project <q>ne permet pas d&#8217;\u00e9tablir la n\u00e9cessit\u00e9 dans laquelle Mme E&#8230; se trouverait d&#8217;effectuer des s\u00e9jours en France de plus de trois mois<\/q>. The practical lesson is direct: repair the health evidence, but also repair the purpose and necessity evidence.<\/p>\n<p>The courts give the administration room to assess a visitor request. In <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000051870290\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000051870290\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Nantes, 8 July 2025, no. 24NT03016<\/a>, the court described the authorities as having a <q>large pouvoir d&#8217;appr\u00e9ciation<\/q>, subject to review by the administrative judge, and accepted that resources and the need for a stay longer than three months could be considered. This is not a licence to reject without reasons. It means that the applicant should present a coherent, evidenced narrative rather than rely on one formal certificate.<\/p>\n<p>Before submission, check translations and names. A UK certificate may use a different format for dates, addresses or names after marriage. Provide a certified French translation where the authority requires one and keep the original. Do not translate the legal effect of an S1 yourself in a way that turns state responsibility into a promise of private insurance. The covering letter can state the document\u2019s function in plain English and, where useful, include the key French terms: <em>assurance maladie<\/em> means health insurance, <em>attestation de droits<\/em> means a certificate of healthcare entitlement, and <em>prise en charge<\/em> means financial responsibility or coverage, depending on context.<\/p>\n<p>Finally, preserve the filing record. Save the application form, document checklist, uploaded files, appointment confirmation, receipt, passport submission record and every message from the consulate or visa centre. If an electronic portal rejects a file, take a dated screenshot and keep the error message. An appeal based on an alleged failure to consider an S1 is much stronger when the applicant can show the precise file name, upload time and acknowledgement.<\/p>\n<h3>B. What are the CRRV and Tribunal administratif de Nantes remedies?<\/h3>\n<p>A refusal is not the end of the process, but the deadlines are short. The first task is to identify whether the refusal is explicit, with a written notification, or implicit because the authority has not decided within the relevant period.
