It is therefore important to establish what happened before treating the missing payment as a tax, banking, or Brexit problem.<\/p>\n<p>This article deals with the urgent, practical question: what can a British pensioner in France do after the DWP says that a Life Certificate was not received or was not accepted? The legal and factual question is more precise: did the DWP receive the requested evidence, in the form and within the time stated in the request, and did it associate that evidence with the correct pension record?<\/p>\n<p>Read every page of the request before completing it. Check the pensioner\u2019s name, National Insurance number, date of birth, address, reference number, date of the request, return address, and any deadline. Use the current form supplied by the DWP rather than an old copy downloaded from an internet forum. If the form requires a witness, follow the form\u2019s conditions exactly. Do not assume that a family member, neighbour, local official, or professional is automatically acceptable. A witness who signs in the wrong place, omits a required detail, or does not satisfy the form\u2019s conditions can create a rejection even where the pensioner is plainly alive.<\/p>\n<p>The witness question is particularly important in France. A mairie is a French town hall. A mairie may be able to certify a French document or explain a local administrative practice, but it does not control the DWP\u2019s overseas pension file. A postal receipt can prove that an envelope was accepted by La Poste or another carrier; it does not prove what the DWP found inside the envelope. A scan of the signed form can show what was sent; it does not by itself prove delivery. A bank statement can show that no credit arrived; it does not establish whether the DWP suspended, recalled, rejected, or redirected the payment. Put the items together in chronological order.<\/p>\n<p>There are at least five different events that a pensioner may describe as \u201cthe pension stopped\u201d:<\/p>\n<ol>\n<li>The DWP issued a suspension decision because it says the Life Certificate was missing.<\/li>\n<li>The DWP says payment was authorised, but the bank rejected or returned the transfer.<\/li>\n<li>The pension was paid but the amount changed because of exchange rates, deductions, tax, or a separate adjustment.<\/li>\n<li>The bank account was closed or restricted, so the payment never became available.<\/li>\n<li>A payment was delayed during an administrative review without a formal suspension being communicated.<\/li>\n<\/ol>\n<p>Ask the DWP to identify which event occurred and the date on which it took effect. If the letter only says that payment has stopped, ask whether the account is suspended, the payment is held, the address is under review, or the transfer has been returned. A precise answer prevents a pensioner from sending proof-of-life documents to the wrong team while the real problem is a bank mandate.<\/p>\n<p>The distinction is also important for arrears. If the DWP reinstates the pension, the correction of future payments and the recovery of missed instalments may be handled separately. Do not assume that an automatic restart answers the arrears question. Ask for the first missed payment date, the amount withheld, the date of reinstatement, and the calculation of any amount due. Retain the letters showing what the DWP accepted and what it did not accept.<\/p>\n<p>French law cannot be used as a shortcut to a DWP decision. Several French provisions refer to proof of existence because France operates its own pension controls. It is not a rule saying that a British resident in France can replace a DWP form with a French certificate.<\/p>\n<p>The same <a href=\"https:\/\/kohenavocats.fr\/avocat-depot-garantie-paris\/\">caution<\/a> applies to <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042675131\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042675131\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 161-24-1<\/a>, which addresses the possibility of proving existence through technical devices using biometric data under conditions fixed by law and regulation. That provision belongs to the French Social Security Code. It does not give a British pensioner an automatic digital alternative to the DWP\u2019s paper process. If the DWP request says that a signed form and witness are required, ask the DWP before relying on another method.<\/p>\n<p>There is a further reason not to treat every certificate as equivalent: a certificate is evidence for a particular decision-maker. The decision-maker needs to be able to identify the person, the relevant benefit, the date of the declaration, and the authority or witness who completed it. A certificate prepared for a French fund may contain all those facts and still be rejected by the DWP if it is not the document requested in the DWP\u2019s procedure.<\/p>\n<h2>II. How can a British pensioner restore payment and challenge the decision?<\/h2>\n<h3>A. What evidence and immediate steps should you send to the DWP?<\/h3>\n<p>Start with a short chronology. It should fit on one page and use dates rather than general descriptions. Record the date of the DWP request, the date it was received in France, the date the Life Certificate was signed, the identity and capacity of the witness, the date and method of posting, the tracking or receipt number, the date of the last payment received, the first missed payment, every call or message to the DWP, and every response. If a document was returned to you, photograph the envelope before opening it and keep the postal marks.<\/p>\n<p>Create an evidence pack in this order:<\/p>\n<ul>\n<li>The DWP request, including every page and the envelope if available.<\/li>\n<li>A copy or scan of the completed Life Certificate before posting.<\/li>\n<li>Any page showing the witness\u2019s signature, name, address, profession, or relationship to the pensioner, if the form asks for those details.<\/li>\n<li>Proof of posting, tracking, delivery, or an explanation from the carrier if delivery cannot be confirmed.<\/li>\n<li>A bank statement or payment history showing the last received payment and the first missing payment, with unrelated transactions redacted.<\/li>\n<li>A clear identity and National Insurance reference page, using only the information the DWP asks for.<\/li>\n<li>Evidence of an address change, if the address on the request was incomplete or old.<\/li>\n<li>Copies of previous correspondence and a list of telephone calls, including dates, departments, and reference numbers.<\/li>\n<\/ul>\n<p>Do not send the only original Life Certificate unless the DWP specifically requires it and you have no safe alternative. If a new form is requested, complete the new form carefully even if you believe the earlier form was valid. State in the covering letter that the new form is provided without abandoning the argument that the earlier form was sent on time. This protects the immediate payment issue while preserving the evidence of an administrative or postal failure.<\/p>\n<p>The covering letter should be factual and easy to scan. Put \u201cUK State Pension suspended after Life Certificate request\u201d at the top, followed by the pensioner\u2019s full name, National Insurance number, date of birth, current French address, telephone number, email address if used by the DWP, and the DWP reference. Then answer four questions:<\/p>\n<ol>\n<li>What did the DWP ask for?<\/li>\n<li>What did the pensioner send, when, and to what address?<\/li>\n<li>When did payment stop?<\/li>\n<li>What action is requested now?<\/li>\n<\/ol>\n<p>The requested action should be explicit. Ask the DWP to link the enclosed evidence to the correct pension record, confirm whether the suspension remains active, reinstate payment, and calculate arrears from the first missed instalment if the pension remained payable. Ask for written confirmation if the DWP believes that the Life Certificate is invalid, late, incomplete, or associated with another record. If a document is missing, ask for the exact document and the reason it is required.<\/p>\n<p>Use the return address and communication channel stated in the current DWP request. The <a href=\"https:\/\/www.gov.uk\/state-pension-if-you-retire-abroad\/report-a-change-in-your-circumstances\">official guidance on reporting a change while receiving State Pension abroad<\/a> is a starting point, but the address printed on an individual Life Certificate request may be more specific. Keep proof of every dispatch. If you telephone, make a note of the time, the name or identifier of the adviser, the case reference, the explanation given, and any promise to call back. A telephone call can move a file forward; a dated letter is usually easier to prove later.<\/p>\n<p>If the pensioner has difficulty dealing with the DWP personally, ask about the DWP\u2019s accepted authority or representative process. A family member can assist with documents, but assistance is not the same as authority to discuss a confidential pension file. Use the DWP\u2019s own form or instructions for consent, power of attorney, or third-party authority. Do not send a general French mandate and assume that it gives the representative access to a UK benefit record.<\/p>\n<p>If you are in France, a mairie may help with a French proof-of-life document, identity copy, or a local explanation of how an official signature is certified. Treat that material as supporting evidence unless the DWP has confirmed that it accepts it in place of its own form. If a translation is requested, ask whether an informal translation is sufficient or whether the DWP requires a particular form of certification. Do not spend money on a formal translation before establishing what the DWP will actually use.<\/p>\n<p>If the pensioner also receives a French pension, open a separate French file. The French expression caisse de retraite means pension fund, but it can refer to different institutions with different processes. A French request should show the fund\u2019s name, the benefit, the deadline, and the method of transmission. The French control-of-existence provisions illustrate why the requested body matters. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042675133\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042675133\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 161-24-2 of the Social Security Code<\/a> says, in the official text, \u201cLa suspension du versement de la pension de retraite dans le cas o\u00f9 le b\u00e9n\u00e9ficiaire ne justifie pas de son existence ne peut avoir lieu qu&#8217;\u00e0 l&#8217;expiration d&#8217;un d\u00e9lai fix\u00e9 par d\u00e9cret.\u201d This is a French rule about a French pension context; it is not a deadline for replying to the DWP.<\/p>\n<p>French law also provides for shared management of proof of existence among compulsory pension regimes. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042675135\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042675135\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 161-24-3<\/a> states, \u201cLes r\u00e9gimes obligatoires de retraite mutualisent la gestion de la preuve d&#8217;existence ainsi que les modalit\u00e9s de son contr\u00f4le au moyen du groupement mentionn\u00e9 \u00e0 l&#8217;article L. 161-17-1, dans des conditions fix\u00e9es par d\u00e9cret.\u201d This explains why a French pension file may be routed through a shared mechanism. It does not allow a French fund to correct a DWP suspension.<\/p>\n<p>The implementing rules reinforce the identity of the requesting organisation. Under <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043330945\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043330945\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article D. 161-2-27<\/a>, the official French text says, \u201cSeul l&#8217;organisme ou le service de l&#8217;Etat d\u00e9sign\u00e9 &#8230; peut demander au b\u00e9n\u00e9ficiaire de fournir, au plus une fois par an, un justificatif d&#8217;existence.\u201d The phrase justificatif d\u2019existence means proof-of-life document. The provision is useful as a warning against answering several institutions with one unexplained certificate. Check who sent the request and which pension it concerns.<\/p>\n<p><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043330947\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043330947\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article D. 161-2-28<\/a> deals with information about a death being shared among members of the French groupement. Its official wording begins, \u201cLe ou les membres du groupement &#8230; ayant connaissance &#8230; du d\u00e9c\u00e8s &#8230; en informent sans d\u00e9lai les autres membres.\u201d This is not a rule about a living British claimant\u2019s DWP appeal. It is cited because a dual-pension household must keep the UK and French administrative records separate and correct any mistaken death or identity signal quickly.<\/p>\n<p>Finally, <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006445235\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006445235\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1983 of the French Civil Code<\/a> contains the principle, \u201cLe propri\u00e9taire d&#8217;une rente viag\u00e8re n&#8217;en peut demander les arr\u00e9rages qu&#8217;en justifiant de son existence, ou de celle de la personne sur la t\u00eate de laquelle elle a \u00e9t\u00e9 constitu\u00e9e.\u201d A rente viag\u00e8re is a life annuity. This old civil-law provision is not the legal foundation of a DWP State Pension Life Certificate, and it should not be presented as though it were. Correct routing is part of the evidence.<\/p>\n<h3>B. What can you do when the DWP does not correct the suspension?<\/h3>\n<p>If the first submission does not resolve the payment, send a second written request that identifies the earlier submission and asks for a review of the record. Attach the chronology, not a new pile of unlabelled documents. State that the payment has stopped, the date of the first missed instalment, the date on which the Life Certificate was sent, and the remedy sought. Ask the DWP to confirm in writing whether it accepts the certificate, rejects it, or cannot locate it.<\/p>\n<p>Ask specific questions rather than relying on a general complaint:<\/p>\n<ul>\n<li>What date was the suspension applied?<\/li>\n<li>What reason and rule were recorded?<\/li>\n<li>Was the Life Certificate received, and if so, on what date?<\/li>\n<li>Was it rejected for a missing signature, witness issue, identity mismatch, late receipt, or another reason?<\/li>\n<li>Is the pension record blocked for a separate address, bank, death, or representation issue?<\/li>\n<li>What document or action will release the suspension?<\/li>\n<li>From what date will missed instalments be recalculated if entitlement continued?<\/li>\n<\/ul>\n<p>Use the complaint or escalation route stated on the current DWP correspondence. The <a href=\"https:\/\/www.gov.uk\/state-pension-if-you-retire-abroad\/report-a-change-in-your-circumstances\">GOV.UK State Pension abroad guidance<\/a> should be read together with the individual decision or request letter because contact routes can change. When you ask for a review, keep the language measured: the central point is that the DWP should identify the evidence it received and give a reasoned answer about reinstatement. Do not describe an administrative error as fraud unless there is evidence for that allegation.<\/p>\n<p>The UK appeal path depends on the decision actually made. A Life Certificate suspension may be dealt with through an administrative correction, a complaint, or a formal decision route. Read the decision letter for any mandatory reconsideration or appeal instruction and its deadline. If the letter does not explain how to challenge the suspension, ask the DWP to identify the applicable review route in writing. The <a href=\"https:\/\/www.legislation.gov.uk\/uksi\/1987\/1968\/contents\">Social Security (Claims and Payments) Regulations 1987<\/a> provide part of the regulatory background for UK social-security administration, but a pensioner should not infer a remedy or deadline from a general regulation link without checking the actual decision and the current DWP instructions.<\/p>\n<p>Do not miss a time limit while waiting for an informal reply. If a letter gives a deadline for review or appeal, submit a protective challenge before that date and explain that supporting evidence has already been sent or is enclosed. Keep the certificate of posting and a complete copy. If you receive a new decision, calculate the next deadline from that decision and do not assume that a telephone assurance extends it.<\/p>\n<p>A French appeal route may apply to a French pension decision, not to the DWP suspension.
