A PACS (pacte civil de solidarit\u00e9, or French civil solidarity pact) is a legal contract with its own registration, publicity and financial consequences. A British partner who has returned to the United Kingdom may therefore remain legally bound to the French PACS until the competent French authority records its dissolution. Brexit changes the surrounding residence, document and tax questions, but it does not turn a French PACS into a UK civil partnership or transfer the French record to a British authority.<\/p>\n<p>The practical answer depends first on where the PACS was registered: a French town hall, a notaire (French civil-law notary), or a French consulate. The same authority normally remains responsible even when the partners now live in different countries. If both partners agree, one of them can usually send the joint declaration and identity documents by registered post. If one partner refuses, cooperation is not required: a commissaire de justice (French judicial officer) can formally serve the unilateral decision and send the required copy to the registering authority.<\/p>\n<p>The date matters. A joint or unilateral dissolution takes effect between the partners when it is registered and becomes opposable to third parties after the civil-status publicity formalities. That date should then be carried into the French tax file, banks, insurers, landlords, pension administrators and, where relevant, a residence application. This guide explains the cross-border procedure, the evidence to preserve and the financial, tax, inheritance and residence issues that a British reader should address after the breakup.<\/p>\n<h2>I. How do you dissolve a French PACS when a British partner lives in the UK?<\/h2>\n<h3>A. Which French authority records the dissolution and what documents are needed?<\/h3>\n<p>The first task is to find the original PACS registration record. Do not send a dissolution request to whichever mairie (French town hall) is closest to your current home. The authority that received the original PACS normally remains the competent authority. The current guidance published by France Diplomatie states that the original town hall, notary or diplomatic or consular post is solely competent to record the dissolution, regardless of the partners\u2019 place of residence. This article takes the next, narrower step: how to end that French record when the partners are no longer in the same country.<\/p>\n<p><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033460726\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033460726\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 515-7 of the French Civil Code<\/a> lists the routes to the end of a PACS. It provides, in the official wording: \u201cLe pacte civil de solidarit\u00e9 se dissout \u00e9galement par d\u00e9claration conjointe des partenaires ou d\u00e9cision unilat\u00e9rale de l&#8217;un d&#8217;eux.\u201d In English, the PACS can end by a joint declaration or by the unilateral decision of one partner. It can also end because of the death of a partner or the marriage of one or both partners. Those events have separate rules for the date on which the dissolution takes effect, but they still need to be recorded and made public in the relevant French civil-status system.<\/p>\n<p>The registration authority can be identified from the date and place of the original PACS:<\/p>\n<ul>\n<li>If a tribunal d\u2019instance (former district court registry) registered the PACS before 1 November 2017, the declaration is handled by the mairie in the municipality where that former court was located.<\/li>\n<li>If a mairie registered the PACS on or after 1 November 2017, send the declaration to that same mairie.<\/li>\n<li>If a notaire registered the PACS, the same notaire or notarial office is the relevant recipient.<\/li>\n<li>If a French embassy or consulate registered the PACS, the same diplomatic or consular post is the relevant recipient.<\/li>\n<\/ul>\n<p>These distinctions appear in the official <a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/R73180\">Cerfa form page for a joint dissolution of a PACS<\/a>. A Cerfa is a standard French administrative form. The form is not a substitute for the registration record: you should locate the original r\u00e9c\u00e9piss\u00e9 (registration receipt), the PACS convention (the agreement signed by the partners), the registration number and any later amendment. If the original file was handled by a notaire or consulate, ask that office which reference it requires before sending a package from the UK.<\/p>\n<p>For a joint dissolution, the partners complete the current form and provide valid identity documents for both of them. The official form allows the partners to appear before the competent civil-status officer, diplomatic or consular agent or notaire. It also allows the form to be sent by registered post with acknowledgement of receipt, with copies of both identity documents. One partner may physically deliver the package, but the declaration remains a joint declaration: the signatures and identity information must be consistent with the registration record.<\/p>\n<p>A British passport is normally the practical identity document for the British partner. If a name, date of birth, nationality or address has changed since the PACS, explain the change and attach the supporting document requested by the receiving authority. A mismatch between the name in the PACS record and the name in the passport can delay the registration. It is safer to ask the mairie, notaire or consulate in writing for its current document list before sending original papers. Keep scans of every document, the postal receipt and the delivery confirmation.<\/p>\n<p>Brexit does not mean that every document in a PACS dissolution file automatically needs an apostille. The need for legalisation depends on the document and on the authority receiving it. Where a French authority asks for a UK public document to be legalised, the <a href=\"https:\/\/www.gov.uk\/get-document-legalised\/apply-for-legalisation\">GOV.UK Legalisation Office process<\/a> explains how to obtain a paper apostille or an e-Apostille. Where a foreign civil-status document is not in French, a French authority may also require a translation by an approved translator. The current Service-Public guidance for a foreign partner confirms that foreign civil-status documents may need a French translation and, in some cases, an apostille or legalisation. Treat that as a document-specific check, not as a reason to apostille every page in the file.<\/p>\n<p>There is a useful cross-border rule in <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033551984\/2026-04-25\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033551984\/2026-04-25\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 515-3-1 of the Civil Code<\/a>. It states that the PACS is recorded in the civil-status margin of each partner and that, for a foreign national born abroad, the information is entered in a register held by the French central civil-status service. The same publicity logic applies to the dissolution. A British partner born in the UK should therefore ask how the dissolution will be recorded in the central register and how a certificate or updated status document can be obtained after registration.<\/p>\n<p>Do not confuse the authority that records the PACS with a service that merely gives general information. Service-Public can direct you to the form; a local town hall can tell you whether it holds the file; the notaire or consulate can confirm its reference. Only the competent registering authority can record the dissolution and trigger the formal publicity. If you send the request to the wrong town hall, the package may be returned without changing your legal status.<\/p>\n<h3>B. What happens if one partner refuses, cannot be contacted or lives abroad?<\/h3>\n<p>A refusal to sign does not give the other partner a veto. Article 515-7 allows a unilateral decision. The text says: \u201cLe partenaire qui d\u00e9cide de mettre fin au pacte civil de solidarit\u00e9 le fait signifier \u00e0 l&#8217;autre.\u201d The French word signification means formal service by a competent judicial officer, not an informal email, text message or ordinary registered letter sent by the partner personally. The modern professional is a commissaire de justice, although older official pages may still use the word huissier de justice.<\/p>\n<p>The unilateral route has two connected acts. First, the commissaire de justice serves the decision on the other partner. Second, a copy of that formal service is delivered or sent to the authority that registered the PACS. The <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/LEGITEXT000006055164\/2026-01-23\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/LEGITEXT000006055164\/2026-01-23\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Decree n\u00b02006-1806 of 23 December 2006<\/a>, as amended, describes the duty of the officer to send the copy to the civil-status officer or the relevant notarial authority. The partner who wants to leave should ask for proof of both acts: the certificate or report of service, and evidence that the registering authority received the copy.<\/p>\n<p>If the other partner is in the UK, give the commissaire de justice the last known address, email address, telephone number and any information about a representative or solicitor. Do not decide yourself that a WhatsApp message or an email is sufficient. The officer must choose a legally effective method and document what was attempted. An incomplete address, a former French address or a refusal to collect a letter can create a proof problem even though the law permits unilateral dissolution. If the address is unknown, explain the search steps and the available evidence to the officer before the act is prepared.<\/p>\n<p>A British partner does not normally need to travel to France merely to make a unilateral decision. The service can be organised from the UK through a French commissaire de justice, with the file sent to the French registration authority. The precise practical route can vary according to the location of the recipient and the registering authority. Ask for a written quotation, the proposed method of service and the documents needed before signing instructions. The service cost is separate from any legal work needed to divide assets or challenge a refusal by the authority.<\/p>\n<p>The unilateral decision is not a request for the other partner\u2019s approval. The receiving authority should register the dissolution once it has the required formal act and the identifying information. If the mairie or notaire refuses to register the file, ask for the refusal in writing and its legal reason. A missing registration receipt, a wrong authority, an illegible identity document or an incomplete act can often be corrected. A genuine dispute about the consequences of the breakup is different: it may need a judge, but it does not normally prevent the civil-status dissolution from being recorded.<\/p>\n<p>Marriage and death follow different routes. Under Article 515-7, the PACS dissolves at the date of the marriage or death, and the civil-status officer or notaire records the event. Do not rely on the word \u201cautomatic\u201d to mean that every bank, tax service, insurer or British institution has been notified. Obtain evidence of the French record and send it to each organisation that still treats the former partner as current.<\/p>\n<p>The official <a href=\"https:\/\/www.service-public.gouv.fr\/telecharger-pdf?path=aHR0cHM6Ly93d3cuc2VydmljZS1wdWJsaWMuZ291di5mci9wYXJ0aWN1bGllcnMvdm9zZHJvaXRzL0YzNTgwNS8wXzFfMD9pZEZpY2hlUGFyZW50PUYxNjIw\">Service-Public separation guidance<\/a> confirms that, where a single partner decides to separate, the commissaire de justice informs the other partner and the mairie. It also confirms the two dates that matter: the date of registration between the partners and the later date of publicity for third parties. Its practical FAQ material is useful, but it does not replace the legal act of service. The file should therefore contain the legal text, the proof of service, the proof of delivery to the registration authority and the final receipt of registration.<\/p>\n<p>There is no French divorce-style requirement to wait for a hearing before a partner can end a PACS unilaterally. The difficult questions usually arise after the registration: who keeps a vehicle, how a joint account is closed, who remains liable on a loan, how the tax year is reported, and whether a residence application relied on the relationship. Those questions should be prepared at the same time as the dissolution, not after a bank or prefecture discovers that the record has changed.<\/p>\n<h2>II. What are the financial, tax and residence consequences after Brexit?<\/h2>\n<h3>A. How do you settle property, debts and tax dates after registration?<\/h3>\n<p>Registration ends the PACS status; it does not itself divide every asset or cancel every contract. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033460726\/2024-01-12\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033460726\/2024-01-12\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 515-7<\/a> states that the partners are to carry out the liquidation of the rights and obligations resulting from the PACS themselves. If they cannot agree, a judge may decide the patrimonial consequences, without prejudice to compensation for harm that may have been suffered. Liquidation means identifying the assets, liabilities, contributions, claims and transfers that must be dealt with. It is not the same thing as the civil-status registration.<\/p>\n<p>Start with a dated schedule. List French and UK bank accounts, savings, vehicles, household goods, shares, insurance policies, pensions, deposits, tax balances and any jointly signed loan. Mark each item as personal, jointly owned, subject to a PACS convention or disputed. Preserve bank statements and purchase invoices covering the period before the PACS, the period of the PACS and the date of dissolution. A partner who moved to the UK should not assume that a French account is closed because the relationship has ended, and a partner remaining in France should not assume that a British account is irrelevant to the French liquidation.<\/p>\n<p>The default property regime is important. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000021330223\/2025-07-08\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000021330223\/2025-07-08\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 515-5 of the Civil Code<\/a> says that each partner keeps the administration, use and disposal of personal property and remains responsible for personal debts, subject to the statutory solidarity for ordinary household debts. It also provides: \u201cLes biens sur lesquels aucun des partenaires ne peut justifier d&#8217;une propri\u00e9t\u00e9 exclusive sont r\u00e9put\u00e9s leur appartenir indivis\u00e9ment, \u00e0 chacun pour moiti\u00e9.\u201d In practical terms, a partner\u2019s name on an informal list is not always enough. The evidence of ownership must be kept with the settlement file.<\/p>\n<p>The partners may have chosen a different regime. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006428523\/2026-03-28\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006428523\/2026-03-28\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 515-5-1<\/a> permits the convention to submit later acquisitions to indivision, meaning joint ownership. The text says that such assets are regarded as jointly owned in equal shares, without a claim by one partner based only on unequal contribution. Find the original convention and every amendment before calculating a balance. A short sentence in the PACS paperwork can change the answer for a vehicle, securities account or other asset acquired after the chosen regime took effect.<\/p>\n<p>The recent <a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000052365857?query=Pacs&#038;searchField=ALL&#038;tab_selection=all\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000052365857\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Cour de cassation, first civil chamber, 1 October 2025, no. 23-22.353<\/a>, illustrates the risk. The Court applied the presumption for non-furnishing movable property acquired during the PACS and explained that \u201cil n&#8217;y a pas lieu de retenir que l&#8217;acte d&#8217;acquisition \u00e9tabli au nom d&#8217;un seul des partenaires en dispose autrement.\u201d A vehicle or other asset registered in one name may still need a careful analysis of the governing PACS regime, the act of acquisition and the evidence. This is not a rule that every asset is automatically split; it is a warning against treating a single name as a complete answer.<\/p>\n<p>Debts require a separate column in the schedule. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006428501\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006428501\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 515-4 of the Civil Code<\/a> provides: \u201cLes partenaires sont tenus solidairement \u00e0 l&#8217;\u00e9gard des tiers des dettes contract\u00e9es par l&#8217;un d&#8217;eux pour les besoins de la vie courante.\u201d That solidarity has limits for manifestly excessive spending, instalment purchases and loans, but the end of the PACS is not a unilateral release from a bank contract, tenancy, utility account or guarantee. Contact the creditor, ask for a written release or transfer, and do not stop payments while the contract remains in both names without a documented agreement.<\/p>\n<p>If one partner pays more than the other after the breakup, preserve proof of the payment and its purpose. Was it a personal debt, a contribution to a joint loan, a temporary occupation payment, child-related expenditure or an advance against the asset settlement? A clear description on each transfer is more useful than a later reconstruction from memory. If the other partner controls the French account and the British partner is abroad, request statements promptly and keep evidence of every request.<\/p>\n<p>The court cases also show why a short settlement cannot be written as if a PACS were a divorce. In <a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000049989162\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000049989162\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Cour de cassation, first civil chamber, 10 July 2024, no. 24-10.157<\/a>, the Court described the statutory rule under which prescription does not run or is suspended between PACS partners during the union. The decision used the phrase \u201cne courrait pas ou serait suspendue pendant la dur\u00e9e de l&#8217;union.\u201d This does not calculate the limitation period for your individual claim, but it is a reason to obtain dates and advice before assuming that a contribution, reimbursement or property claim has expired.<\/p>\n<p>If the disagreement is about the consequences of the breakup rather than the act of dissolution, the competent French court may need to decide. The official Service-Public guidance directs partners who disagree about patrimonial consequences or compensation for harm to the judge with jurisdiction over the case. A British partner should not send a vague claim to a French court without checking jurisdiction, service of proceedings, language requirements, applicable law and the location of the assets. The French civil-status step and the cross-border litigation step are related but not identical.<\/p>\n<p>Finally, record the date for tax purposes. The French tax administration treats the year of a PACS rupture as a year in which each former partner has to deal with personal income and charges. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041471369\/2026-05-23\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041471369\/2026-05-23\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 6 of the French General Tax Code<\/a> provides that partners in a PACS are jointly taxed while the PACS exists and that, in the year of dissolution, each former partner is personally taxable on personal income and on the relevant share of common income. The tax position is not necessarily the same as the date on which the couple physically moved apart.<\/p>\n<h3>B. How can the dissolution affect French tax, residence rights, inheritance and UK documents?<\/h3>\n<p>Report the French rupture promptly. The current <a href=\"https:\/\/www.impots.gouv.fr\/particulier\/je-viens-de-divorcer-ou-de-rompre-mon-pacs\">impots.gouv.fr guidance for a divorce or PACS rupture<\/a> asks taxpayers to report the event through the \u201cG\u00e9rer mon pr\u00e9l\u00e8vement \u00e0 la source\u201d service within 60 days. Each former partner then gives the administration an estimate of personal income for the current year. In the annual return, the partners file separately for the year of the rupture with their own income and charges for the full year, subject to the rules for common income and family responsibilities.<\/p>\n<p>This matters to a British partner who has gone back to the UK. The French tax file may still contain a joint address, joint bank details and joint income history. Update the French account, but consider address confidentiality before changing information that will appear in shared historical tax documents. If French-source rental income, a French pension, a capital gain or property-related tax remains in the file, the end of the PACS does not remove the underlying French tax issue. It changes the household and reporting structure that must be applied to it.<\/p>\n<p>Joint tax liability also needs to be checked separately. <a href=\"https:\/\/www.impots.gouv.fr\/particulier\/questions\/je-divorce-ou-rompt-mon-pacs-qui-doit-payer-les-impots-communs\">The tax administration explains that former partners can remain jointly responsible for tax arising from the period in which they were jointly assessed<\/a>. Do not sign a private agreement saying that one former partner will pay and assume that the agreement binds the French tax authority. If a UK bank account, pension or investment was omitted from an earlier French return, correct that issue with advice rather than treating the PACS rupture as a reset button.<\/p>\n<p>Residence rights need a separate analysis. A British citizen may have lived in France under a Withdrawal Agreement residence document, a later French visa or another status. The end of a PACS does not give a universal answer. The relevant questions include the legal basis of the current card, the date of residence in France, independent work or resources, health cover, the length of the relationship and whether the person is applying for renewal or a change of status.<\/p>\n<p>For an ordinary French \u201cprivate and family life\u201d route, the official <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F2209?lang=fr\">Service-Public residence guidance<\/a> lists a PACS with a French national, the reality of the relationship and normally at least one year of common life among the facts that can matter. It also says that foreign civil-status acts must be accompanied by a French translation and may require an apostille or legalisation. That guidance is not a complete statement of the special Withdrawal Agreement regime. It does show why a partner should not conceal or casually describe a separation in a pending application.<\/p>\n<p>The British side also has its own documents and status rules. GOV.UK\u2019s official material on <a href=\"https:\/\/www.gov.uk\/government\/publications\/residence-rights-under-the-withdrawal-agreement\">residence rights under the Withdrawal Agreement<\/a> explains that the agreement protects specific residence situations and family-member rights, not every relationship that once existed. If your French residence status is independent of the PACS, the dissolution may have a limited immigration effect. If the PACS was the central evidence for a family connection, a pending application or a renewal, obtain advice before assuming that the French registration has no immigration consequence. Keep the old PACS certificate, the dissolution receipt and proof of your independent basis of residence together.<\/p>\n<p>Inheritance planning should be reviewed at the same time. A PACS is not a substitute for a will. In <a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000036697078\/\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000036697078\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Cour de cassation, first civil chamber, 28 February 2018, no. 17-10.876<\/a>, the Court referred to the fact that \u201cles partenaires du pacte civil de solidarit\u00e9 n&#8217;ont pas la qualit\u00e9 d&#8217;h\u00e9ritiers.\u201d A surviving PACS partner may benefit from a will and from specific tax rules, but the status alone does not make the former partner an heir in the same way as a child or a spouse. After dissolution, review French and UK wills, life-insurance beneficiary nominations, pension death-benefit nominations, joint accounts and powers of attorney.<\/p>\n<p>A shared note or informal promise is also not a safe substitute for a valid will.
