If it is, the holder must complete a separate validation after arrival. A missed deadline, an incorrect visa category, an unavailable ANEF portal or an unexplained refusal can turn a routine online form into a serious residence problem.<\/p>\n<p>The first practical question is not \u201cHow do I pay the tax?\u201d It is \u201cWhat exactly does the visa sticker say, and on what date did I enter France?\u201d A VLS-TS, a long-stay visa marked \u201ccarte de s\u00e9jour \u00e0 solliciter\u201d, and a temporary long-stay visa do not create the same duties. This article separates those routes, explains the three-month rule, identifies the evidence to preserve when the French digital portal fails, and sets out the administrative and urgent court remedies that may be available. It also distinguishes a post-Brexit newcomer from a British citizen protected by the Withdrawal Agreement because he or she was already lawfully living in France before 1 January 2021.<\/p>\n<p>The objective is practical: secure proof of lawful residence, avoid an unsafe trip outside the Schengen area, protect access to work and healthcare where the relevant documents permit it, and ask the <em>pr\u00e9fecture<\/em> (the local office of the French state responsible for immigration administration) for a decision that can be challenged if the problem is not corrected.<\/p>\n<h2>I. Do British citizens have to validate a French long-stay visa after Brexit?<\/h2>\n<h3>A. Article R. 431-16 CESEDA begins with the words \u201cSont dispens\u00e9s de souscrire une demande de carte de s\u00e9jour\u201d and then lists the categories, including certain spouses, employees, entrepreneurs, talent applicants, students, visitors and family members. The relevant category must match the visa wording. A British visitor, a British spouse of a French national, a British employee and a British family member may therefore hold documents with different consequences even though each person describes the document in English as a \u201cFrench long-stay visa\u201d.<\/p>\n<p>Do not infer the category from the purpose stated in an old visa application. Read the visa\u2019s printed mention, the duration, the number of entries and any wording about a card application. Keep a high-resolution scan of every passport page containing the visa, including the machine-readable area and any handwritten or stamped addition. The provision refers to declaring, in particular, the date of entry and the French domicile through an online service. The official <a href=\"https:\/\/www.france-visas.gouv.fr\/en\/web\/france-visas\/votre-arrivee-en-france\">France-Visas arrival guidance<\/a> gives the same three-month operational deadline for a VLS-TS.<\/p>\n<p>The date of entry must be proved, not merely remembered. Keep the flight or Eurostar booking, boarding pass, passport stamp if one was made, hotel or temporary accommodation evidence, the first French tenancy document, and any dated purchase made immediately after arrival. A British citizen who entered France several times should prepare a short chronology identifying the first entry made under the VLS-TS and distinguishing it from earlier short visits. The system will normally ask for the date entered in France; an incorrect date can affect the legal period and later dealings with the prefecture.<\/p>\n<p>The online process commonly requires the visa number, passport information, an email address, the entry date, the French address and payment of the electronic immigration tax or stamp applicable to the category. The exact amount and payment route can vary with the type of visa and the current administrative instructions. Use the amount displayed by the official portal or the current France-Visas instructions, and keep the payment receipt. A bank statement showing a card debit is useful, but it is not a substitute for the electronic tax-stamp reference or confirmation generated by the platform.<\/p>\n<p>At the end of a successful validation, download the confirmation immediately. Save the PDF in two places, keep the confirmation email in its original form, and print a copy for travel. Note the personal or foreign-national file number shown on the document. If the portal produces a screen but no downloadable certificate, take a dated screenshot showing the application number, the visa category and the status. If the status later changes, save the new version rather than overwriting the earlier evidence.<\/p>\n<p>A validation confirmation is not a universal work permit. The right to work depends on the visa category, the employment route and the document presented to the employer. A visitor VLS-TS, for example, is not an employee authorisation simply because it has been validated. A salari\u00e9 visa, meaning an employee visa, may be tied to the employment conditions approved during the application. A British citizen should not allow an employer to rely on an informal translation of the visa when the printed mention or the validation certificate says something different.<\/p>\n<p>The same distinction matters at the end of the first year. A VLS-TS normally covers the period printed on the document; it does not silently renew itself. If the holder intends to remain in France, the next residence application must be filed through the route and within the period stated by the prefecture. The earlier validation confirmation will often be an important part of that later file. What if the VLS-TS validation fails or the three-month deadline has passed?<\/h2>\n<h3>A. Which documents prove the failure, and what can you ask the prefecture to do?<\/h3>\n<p>There is a material difference between a British citizen who simply forgot the deadline and a British citizen who tried to comply but was prevented by a technical or administrative failure. The remedy will depend on the evidence. A portal error shown only by memory is difficult to litigate. A sequence of screenshots, support tickets and dated written requests can show that the applicant acted before the deadline and that the administration had the information needed to solve the problem.<\/p>\n<p>Start with a one-page timeline. Record the date of entry, the date the ANEF account was created, each attempted submission, the exact error message, each payment attempt, every call or email to support, the date the prefecture was contacted, the expiry date printed on the visa and any resulting refusal of work, healthcare or travel. Add the time zone if the portal displayed a cut-off time. Keep the original email headers where possible. A screenshot should show the URL, the computer or phone date and the whole error message; a cropped image containing only one button is weak evidence.<\/p>\n<p>The request to the prefecture should be concrete. Ask for the validation to be completed, for a manual or alternative route to be opened, for the foreign-national file number needed to continue the residence procedure, or for a document confirming the position while the technical problem is examined. Attach the visa, passport identity page, proof of entry, address evidence, the attempted application and the payment record. Use the prefecture\u2019s instructed channel and preserve the delivery proof. A generic message saying \u201cthe website does not work\u201d should be replaced by a numbered chronology and a precise requested measure.<\/p>\n<p>Where a residence-card application has also been accepted, the provisional document becomes central. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042806980\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042806980\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 431-12 CESEDA<\/a> states that an applicant \u201cse voit remettre un r\u00e9c\u00e9piss\u00e9 qui autorise sa pr\u00e9sence sur le territoire pour la dur\u00e9e qu&#8217;il pr\u00e9cise\u201d. A <em>r\u00e9c\u00e9piss\u00e9<\/em> is a temporary receipt issued for a residence application. It is not the same as a confirmation that an online account was created, a submission receipt that contains no residence authorisation, or an appointment invitation. The wording, dates and category printed on the document must be checked.<\/p>\n<p>The work consequence must be analysed separately. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042806974\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042806974\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article R. 431-15 CESEDA<\/a> provides: \u201cLe r\u00e9c\u00e9piss\u00e9 de demande de renouvellement d&#8217;une carte de s\u00e9jour permettant l&#8217;exercice d&#8217;une activit\u00e9 professionnelle autorise son titulaire \u00e0 exercer une activit\u00e9 professionnelle.\u201d That text concerns the receipt for a renewal of a residence card allowing professional activity. It should not be copied mechanically onto a first VLS-TS validation problem. The visa, the residence route and the document actually issued must show whether work is authorised.<\/p>\n<p>Two administrative court decisions show why the evidence matters. In <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000051538776\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000051538776\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">CAA Paris, interim judge, 30 April 2025, no. 24PA04810<\/a>, the court examined a VLS-TS holder who had tried to declare the entry date and domicile through ANEF within three months. The decision records that \u201cun dysfonctionnement de la plateforme ANEF a emp\u00each\u00e9 Mme A&#8230; \u00e9pouse B&#8230; d&#8217;acc\u00e9der \u00e0 la d\u00e9marche\u201d. It also found that the administration\u2019s failure to remedy the problem in time could engage the State\u2019s liability, while the amount and causal link still had to be proved. This is not an automatic compensation rule for every late validation; it is a reminder to prove the attempt, the warning given to the administration and the actual loss.<\/p>\n<p>If the administration refuses the request or gives no usable explanation, ask for the legal basis and the factual reasons in writing. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031367505\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031367505\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 211-2 of the <em>Code des relations entre le public et l&#8217;administration<\/em><\/a> states: \u201cLes personnes physiques ou morales ont le droit d&#8217;\u00eatre inform\u00e9es sans d\u00e9lai des motifs des d\u00e9cisions administratives individuelles d\u00e9favorables qui les concernent.\u201d A written response identifies whether the problem is a wrong visa category, a missing entry record, an unpaid tax, an expired visa, a refusal to use a substitute channel or a position that the person no longer has lawful residence. Each reason calls for a different response.<\/p>\n<p>Silence is not the same as validation. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031367611\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031367611\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 231-1 of the same code<\/a> says: \u201cLe silence gard\u00e9 pendant deux mois par l&#8217;administration sur une demande vaut d\u00e9cision d&#8217;acceptation.\u201d That general rule has statutory exceptions and does not turn a failed VLS-TS portal transaction into a residence certificate. It may also be necessary to identify the exact request and the applicable special rule before calculating a presumed decision. Do not rely on silence to board a flight or to start work when no document proves lawful residence or work authorisation.<\/p>\n<p>A late voluntary filing still requires a prompt approach. The request should acknowledge the missed date, explain the cause, attach evidence of the reason and ask the prefecture to indicate the correct procedure. The person should avoid creating multiple inconsistent applications, changing the entry date to make the form accept it, or selecting a different visa category merely because the first category is unavailable online. A false date or an inaccurate category can create a more serious difficulty than the original delay.<\/p>\n<h3>B. Can you bring an urgent court application, travel or keep working?<\/h3>\n<p>Travel is the immediate risk in many VLS-TS cases. The official France-Visas arrival guidance warns that a holder who has not validated the VLS-TS within the required period may no longer be in regular residence and may not be able to cross the Schengen external border again on the same basis. A British passport does not replace the missing French residence document for a person who intends to return for a long stay. The <a href=\"https:\/\/www.gov.uk\/foreign-travel-advice\/france\/entry-requirements\">GOV.UK entry-requirements guidance for France<\/a> should be checked alongside the French document, but it is not a promise that an airline or border officer will accept an unresolved ANEF file.<\/p>\n<p>Before leaving France, obtain a written answer about the document that will permit return. A portal account, a payment receipt, an email saying that a ticket has been opened and an expired visa do not necessarily have the same legal effect. If the applicant must travel because of a death, urgent medical care or a compelling family event, the request to the prefecture should identify the departure and return dates and ask for a document expressly addressing re-entry. If the prefecture does not respond, the evidence of urgency must be preserved for any court application.<\/p>\n<p>Work creates a second risk. The employer may ask for a validation certificate, a residence card, a receipt or an attestation of prolongation of instruction. An <em>attestation de prolongation d&#8217;instruction<\/em> is a temporary certificate showing that a residence application remains under examination. Its effect depends on the route and the wording. A British citizen should not promise an employer that a pending VLS-TS validation automatically extends the right to work. The safer approach is to place the visa, the validation evidence and any provisional document before an immigration lawyer and the employer\u2019s compliance team.<\/p>\n<p>An urgent application to the administrative court must match the procedural problem. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006449328\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006449328\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 521-3 of the Code of Administrative Justice<\/a> provides: \u201cEn cas d&#8217;urgence et sur simple requ\u00eate qui sera recevable m\u00eame en l&#8217;absence de d\u00e9cision administrative pr\u00e9alable, le juge des r\u00e9f\u00e9r\u00e9s peut ordonner toutes autres mesures utiles\u201d. This is the basis commonly described as <em>r\u00e9f\u00e9r\u00e9 mesures utiles<\/em>, an urgent interim application seeking a practical measure. In a VLS-TS dispute, the requested measure may be a technical route to file, registration of the application, delivery of a document or examination of a blocked request. It should not be drafted as a vague demand that the court manage the entire immigration file.<\/p>\n<p>If there is a formal refusal or another administrative decision whose effects need to be stopped, <em>r\u00e9f\u00e9r\u00e9-suspension<\/em> may be relevant. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006449326\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006449326\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 521-1<\/a> states that the judge may suspend a decision \u201clorsque l&#8217;urgence le justifie et qu&#8217;il est fait \u00e9tat d&#8217;un moyen propre \u00e0 cr\u00e9er, en l&#8217;\u00e9tat de l&#8217;instruction, un doute s\u00e9rieux quant \u00e0 la l\u00e9galit\u00e9 de la d\u00e9cision\u201d. The application therefore needs both urgency and an arguable legal defect: for example, an error about the visa category, a failure to consider proof of a timely attempted validation, a refusal based on a factually wrong entry date or a failure to give required reasons.<\/p>\n<p><em>R\u00e9f\u00e9r\u00e9-libert\u00e9<\/em>, the urgent procedure for protecting a fundamental freedom, has a higher threshold. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006449327\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006449327\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 521-2<\/a> requires an urgent situation and a \u201catteinte grave et manifestement ill\u00e9gale\u201d to a fundamental freedom; the judge must decide within forty-eight hours. A missed online appointment will not automatically satisfy that test. The threshold may become more credible where the applicant can show an immediate and serious interference with lawful work, family life, access to essential care or the ability to remain in France, together with clear evidence that the administration has refused to provide the document or the alternative route required by the situation.<\/p>\n<p>The recent <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000054151520\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000054151520\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Conseil d&#8217;\u00c9tat, interim judge, 28 May 2026, no. 515624<\/a>, concerned a residence renewal rather than a first VLS-TS validation, but it illustrates the importance of the provisional document. The order records that the receipt authorised \u201csa pr\u00e9sence sur le territoire et l&#8217;exercice d&#8217;une activit\u00e9 professionnelle\u201d. The case became without object after the prefecture summoned the applicant and delivered the receipt. The practical lesson for a British VLS-TS holder is not that every request will succeed; it is that a court file should identify the exact document needed, the expiry date, the work or travel consequence and the steps already taken with the administration.<\/p>\n<p>Where an application seeks a court-ordered measure after a decision on the merits, <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038311379\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000038311379\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article L. 911-1 of the Code of Administrative Justice<\/a> permits the court to prescribe the required execution measure: \u201cla juridiction, saisie de conclusions en ce sens, prescrit, par la m\u00eame d\u00e9cision, cette mesure assortie, le cas \u00e9ch\u00e9ant, d&#8217;un d\u00e9lai d&#8217;ex\u00e9cution\u201d. The request should name the authority, the act to be completed, the document to be issued, the deadline and, where justified, an astreinte (a financial penalty for delay). A court is more likely to act on an operational request supported by a clear chronology than on a general complaint about the quality of the immigration portal.<\/p>\n<p>The file should also separate the legal remedy from any compensation claim. If the failure caused hospital bills, loss of earnings, cancelled travel, employment suspension or other expenses, collect invoices, payslips, employer letters, cancellation records and proof that the loss followed from the missing document. In CAA Paris no. 24PA04810, the court connected the ANEF failure to the applicant\u2019s inability to prove regular residence and to a loss connected with healthcare access.
