The annual <em>taxe fonci\u00e8re<\/em> \u2014 the French property tax on buildings and land \u2014 does not wait for the English or French estate paperwork to finish. The practical question is therefore not simply who receives the notice. It is who is legally liable for the year, who must advance the money, how the cost is divided between heirs, and what happens when one heir refuses to contribute.<\/p>\n<p>The answer is governed by two layers of law. French tax law identifies the person or estate appearing on the tax roll, fixes liability by reference to 1 January, and sets the procedure for a claim. French succession and co-ownership law then determines how the debt is administered internally. A death certificate, a British will, an English executor or a delay in obtaining an <em>acte de notori\u00e9t\u00e9<\/em> \u2014 the French notarial deed establishing the identity of heirs \u2014 does not by itself suspend the tax. This guide explains the position for a French property forming part of a British-connected estate, including a property held by several heirs in <em>indivision<\/em>, meaning shared ownership before partition. It also covers a surviving spouse with <em>usufruit<\/em>, the right to use the property and receive its income, while children hold the <em>nue-propri\u00e9t\u00e9<\/em>, the bare ownership.<\/p>\n<h2>I. Who is legally liable for French taxe fonci\u00e8re after a UK owner&#8217;s death?<\/h2>\n<h3>A. Does the tax stay in the deceased&#8217;s name and who pays at 1 January?<\/h3>\n<p>The starting point is the nature of the tax. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006305965\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006305965\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1380 of the French Code g\u00e9n\u00e9ral des imp\u00f4ts<\/a> provides: \u201cLa taxe fonci\u00e8re est \u00e9tablie annuellement sur les propri\u00e9t\u00e9s b\u00e2ties sises en France \u00e0 l&#8217;exception de celles qui en sont express\u00e9ment exon\u00e9r\u00e9es par les dispositions du pr\u00e9sent code.\u201d In other words, a building situated in France is assessed annually because of its French location. The owner&#8217;s British nationality, residence in the United Kingdom, or absence of French income does not remove the tax. The official <a href=\"https:\/\/www.impots.gouv.fr\/particulier\/questions\/je-suis-non-resident-suis-je-concerne-par-les-impots-locaux\">guidance for non-residents on local taxes<\/a> directs a non-resident owner to the tax service responsible for the property.<\/p>\n<p>The legal taxpayer is normally the owner. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000034110958\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000034110958\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1400 of the Code g\u00e9n\u00e9ral des imp\u00f4ts<\/a> states that \u201ctoute propri\u00e9t\u00e9, b\u00e2tie ou non b\u00e2tie, doit \u00eatre impos\u00e9e au nom du propri\u00e9taire actuel.\u201d It then gives specific rules where an immovable is subject to usufruit. The annual reference date is decisive. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051219169\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051219169\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1415<\/a> says: \u201cLa taxe fonci\u00e8re sur les propri\u00e9t\u00e9s b\u00e2ties, la taxe fonci\u00e8re sur les propri\u00e9t\u00e9s non b\u00e2ties et la taxe d&#8217;habitation sur les r\u00e9sidences secondaires sont \u00e9tablies pour l&#8217;ann\u00e9e enti\u00e8re d&#8217;apr\u00e8s les faits existants au 1er janvier de l&#8217;ann\u00e9e de l&#8217;imposition.\u201d There is no ordinary daily apportionment by the tax authority because the owner died on 15 March or because the sale completed on 20 September. The year is assessed by the facts existing on 1 January.<\/p>\n<p>That produces two common outcomes. If the owner died on 15 March 2026, the 2026 taxe fonci\u00e8re remains a charge connected with the deceased&#8217;s estate. If the owner was alive on 1 January 2026 and the death occurred later in the year, the death does not create a fresh 2026 assessment for each heir. If the owner died before 1 January 2026, the heirs may already hold the property in an indivision on that date, subject to the registration position and any usufruit. The exact wording of the notice can lag behind the legal transfer. A notice addressed to \u201cSuccession of\u201d the deceased is not proof that one named heir personally owns the whole debt.<\/p>\n<p>French succession law explains why the estate can continue to be treated as the relevant owner while the file is being settled. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006430730\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006430730\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 724 of the Code civil<\/a> provides: \u201cLes h\u00e9ritiers d\u00e9sign\u00e9s par la loi sont saisis de plein droit des biens, droits et actions du d\u00e9funt.\u201d The heirs therefore receive the deceased&#8217;s property rights by operation of law, even though the formal property certificate and cadastral update may still be pending. If more than one person inherits the French property, the property is usually held in an indivision until it is sold, divided or assigned to one heir with compensation to the others. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006432351\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006432351\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 815 of the Code civil<\/a> states: \u201cNul ne peut \u00eatre contraint \u00e0 demeurer dans l&#8217;indivision et le partage peut toujours \u00eatre provoqu\u00e9, \u00e0 moins qu&#8217;il n&#8217;y ait \u00e9t\u00e9 sursis par jugement ou convention.\u201d The existence of that temporary shared ownership does not suspend local tax.<\/p>\n<p>The cadastral position is particularly important for a British family dealing with a French notaire. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006306077\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006306077\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1403 of the Code g\u00e9n\u00e9ral des imp\u00f4ts<\/a> provides: \u201cTant que la mutation cadastrale n&#8217;a pas \u00e9t\u00e9 faite, l&#8217;ancien propri\u00e9taire continue \u00e0 \u00eatre impos\u00e9 au r\u00f4le, et lui ou ses h\u00e9ritiers naturels peuvent \u00eatre contraints au paiement de la taxe fonci\u00e8re, sauf leur recours contre le nouveau propri\u00e9taire.\u201d A <em>mutation cadastrale<\/em> is the administrative update of the cadastral tax record after a change of ownership. It is not the same thing as the private agreement among the family about who should transfer the money.<\/p>\n<p>The Conseil d&#8217;\u00c9tat applied this rule directly in its decision of 20 April 1977, no. 02525. The official <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000007616213\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000007616213\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">decision no. 02525<\/a> concerned property still held in indivision by heirs and confirmed that the tax could remain entered in the deceased&#8217;s name, represented collectively by the succession. The fact that an assessment notice was sent to only one heir did not change the tax roll or make that heir the exclusive debtor. That distinction is crucial where a British heir receives the letter because they are the only person with a French address or because the notaire has listed them as the correspondence contact.<\/p>\n<p>The more recent Conseil d&#8217;\u00c9tat decision of 20 October 2016, no. 388940, is even more practical. In <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000033285450\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000033285450\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">decision no. 388940<\/a>, the court held: \u201cIl r\u00e9sulte de ces dispositions qu&#8217;en cas de d\u00e9c\u00e8s du propri\u00e9taire et tant que la mutation cadastrale n&#8217;a pas \u00e9t\u00e9 faite, les h\u00e9ritiers du propri\u00e9taire sont chacun tenus \u00e0 hauteur de leur part dans l&#8217;indivision au paiement de la taxe fonci\u00e8re.\u201d It added that the obligation of an indivisor cannot exceed their share because solidarity does not arise automatically from being an indivisor. Thus, the tax may be issued under the deceased&#8217;s name while each heir&#8217;s internal burden remains linked to their percentage in the estate.<\/p>\n<p>Suppose a British mother leaves a French house to two children in equal shares. One child lives in London and the other lives near Bordeaux. The Bordeaux child may receive the notice, contact the <em>service des imp\u00f4ts<\/em>, and pay the whole amount to prevent late-payment action. That payment does not turn the Bordeaux child into the sole owner or the sole person liable between the heirs. Subject to the succession documents and any usufruit, the paying child can seek contribution for the other half. The family should record the payment, the tax year, the property, the exchange rate if money came from a sterling account, and the request for reimbursement.<\/p>\n<h3>B. How do usufruit, bare ownership, sale and an unpaid bill alter the answer?<\/h3>\n<p>A British will or an intestacy arrangement may leave the surviving spouse with usufruit and the children with nue-propri\u00e9t\u00e9. This is a different legal structure from a simple indivision. Article 1400 specifically provides that where a building is subject to usufruit, the taxe fonci\u00e8re is established in the name of the usufruitier. The Conseil d&#8217;\u00c9tat explained the consequence in its decision of 4 January 1978, no. 08507: \u201cla taxe fonci\u00e8re est \u00e9tablie au nom de l&#8217;usufruitier.\u201d The official <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000007661794\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000007661794\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">decision no. 08507<\/a> also shows that a private arrangement under which a bare owner pays the bill does not make the bare owner the legal taxpayer for other public-law purposes.<\/p>\n<p>The family can agree that the children will fund the tax, especially where the surviving spouse has limited cash or the estate has been arranged to protect the spouse. That agreement should be written into the estate accounts. It should not be confused with the identity of the redevable l\u00e9gal, the legally liable taxpayer named by the tax rules. If the notice is wrong because it names a child as sole owner even though the spouse has usufruit, the family should preserve the deed, the attestation de propri\u00e9t\u00e9 immobili\u00e8re and the usufruit clause before asking for a correction. The <em>attestation de propri\u00e9t\u00e9 immobili\u00e8re<\/em> is the French notarial deed recording the transfer of an immovable from the deceased to the heirs.<\/p>\n<p>A sale creates a second distinction. The date of completion may determine who is responsible under the sale deed for a private prorata, but the tax authority applies the statutory annual rule. If the deceased or the estate owned the property on 1 January, the estate-side owner remains associated with that year&#8217;s assessment. The deed can require the buyer to reimburse a proportion for the period after completion, but the clause is an arrangement between the contracting parties. It does not rewrite Article 1415 or automatically alter the tax roll. Before relying on a sale clause, compare the completion date, the 1 January owner, the cadastral update and the wording of the notaire&#8217;s statement of account.<\/p>\n<p>Article 1403 also matters after the property has been sold from the estate. Until the cadastral mutation has been made, the former owner or heirs may still be pursued on the role, subject to their recourse against the new owner. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006311587\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006311587\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1404<\/a> provides a mechanism for a discharge when tax was assessed in the name of someone other than the legal taxpayer, but the formal obligations for updating the record must be respected. The legal rule is not a substitute for sending the notaire the signed deed and checking that the publication at the <em>service de la publicit\u00e9 fonci\u00e8re<\/em> has been completed.<\/p>\n<p>Payment is not necessarily an act of acceptance of an uncertain estate. <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000030254044\/2026-02-23\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000030254044\/2026-02-23\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 784 of the Code civil<\/a> treats as purely conservatory acts, among others, \u201cle paiement des frais fun\u00e9raires et de derni\u00e8re maladie, des imp\u00f4ts dus par le d\u00e9funt, des loyers et autres dettes successorales dont le r\u00e8glement est urgent\u201d. This allows a person who has not yet taken the title of heir to deal with urgent estate liabilities without that act alone being treated as a tacit acceptance. A British beneficiary who is unsure whether the estate contains other debts should still obtain advice about the acceptance option before taking wider steps, signing a sale agreement or distributing assets.<\/p>\n<p>Once an heir accepts the succession purely and simply, <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006431541\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006431541\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 785<\/a> provides that the heir answers indefinitely for the debts and charges of the estate. French law also allows an heir to declare that they accept only up to the net estate assets. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006431560\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006431560\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 787<\/a> states: \u201cUn h\u00e9ritier peut d\u00e9clarer qu&#8217;il n&#8217;entend prendre cette qualit\u00e9 qu&#8217;\u00e0 concurrence de l&#8217;actif net.\u201d The annual property tax is a comparatively ordinary charge, but the payment strategy should be coordinated with the notaire when the estate has a mortgage, unpaid works, several properties or an uncertain British liability.<\/p>\n<p>The official <a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/F263\">Service-Public explanation of local taxes in an indivision<\/a> gives the operational answer: the tax for the year of death is a debt of the succession; where there are several heirs, each pays according to their share; and the notaire can pay the whole bill from available estate funds if all heirs authorise that arrangement. That is the cleanest route where the French estate account has enough money. It avoids one heir becoming an involuntary lender to the family and creates a documentary trail for the eventual distribution.<\/p>\n<h2>II. How can British heirs organise, contest and recover the taxe fonci\u00e8re?<\/h2>\n<h3>A. What should the executor, notary or heir do before paying?<\/h3>\n<p>The first step is to identify the precise debt. Obtain every page of the <em>avis de taxe fonci\u00e8re<\/em>, the French property-tax notice, and record the tax year, property address, cadastral references, owner wording, assessed base, local rates, waste-collection line and payment deadline. Do not rely on a photograph of the first page. A British heir should ask the French contact person, the notaire and the property manager whether another notice was issued for the same commune. If the property is part of a larger building, check whether the notice concerns the whole building, a lot, land, an outbuilding or a business portion.<\/p>\n<p>Next, create a one-page ownership timeline. Put the death date, the date of the will or inheritance certificate, the date the heirs accepted or renounced, the date of the attestation de propri\u00e9t\u00e9, the date of publication, the date of any sale and the date of the cadastral update in separate columns. Mark who held full ownership, usufruit or nue-propri\u00e9t\u00e9 on each 1 January. This prevents a frequent error: using the date on which a British probate or French notarial document was signed as if it were the statutory tax date.<\/p>\n<p>The amount itself should be tested against the property record. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006311555\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006311555\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1388 of the Code g\u00e9n\u00e9ral des imp\u00f4ts<\/a> bases the tax on the cadastral rental value, known in French as the <em>valeur locative cadastrale<\/em>, rather than on the current estate-agent market value. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000036364491\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000036364491\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1495<\/a> says that each property is assessed by its composition, use, location and condition at the relevant assessment date. For an ordinary dwelling, <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000034111395\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000034111395\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1496<\/a> provides a comparison method, while <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000053546553\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000053546553\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1498<\/a> deals with professional or exceptional premises. A holiday home that was converted into a furnished rental, a barn that became part of the dwelling, or a mixed-use building may therefore need a more careful classification review.<\/p>\n<p>Recent case law shows why the estate file must contain measurements and not merely a complaint that the bill is high. In <a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/CETATEXT000052354356\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/CETATEXT000052354356\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Conseil d&#8217;\u00c9tat decision no. 497701 of 3 October 2025<\/a>, the court dealt with a local-tax dispute involving the surface used for a parking facility and a partial discharge after part of the assessment was corrected. The premises were professional, so the decision is not a universal rule for a French second home. It is nevertheless a useful evidential model: identify the precise surface, the precise use and the precise part of the assessment that is wrong. In <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000029003693\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000029003693\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Conseil d&#8217;\u00c9tat decision no. 372249 of 28 May 2014<\/a>, no. 372249, the court examined the valuation method applicable to professional buildings and land. A claim should explain the legal method that should apply instead of asking for a general reduction.<\/p>\n<p>Vacancy is a separate issue for an estate. A French property left empty while heirs live in Britain is not automatically exempt. Article 1389 requires conditions relating to the nature of the property, the duration of the vacancy and the fact that the vacancy or non-use is independent of the taxpayer&#8217;s will. The official <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042159767\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000042159767\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Article 1389 text<\/a> should be read before presenting the claim. In <a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000008212653\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000008212653\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">Conseil d&#8217;\u00c9tat decision no. 265562<\/a>, the court said that the vacancy test \u201cob\u00e9it \u00e0 des crit\u00e8res objectifs diff\u00e9rents\u201d from another vacant-homes tax. A weak rental market or an intention to sell is not automatically enough.
