In <a href=\"https:\/\/www.courdecassation.fr\/decision\/6a45fd8bcdc6046d478a9a38\">Cass. 3e civ., 2 July 2026 (no. 24-20.650)<\/a>, the Court ruled that a syndic who fails to issue calls for funds to finance works voted by the general assembly commits a fault engaging its personal liability. This was applied to defective hot-water pipework that created a risk of legionella bacteria development, despite no actual infection having been proven. In <a href=\"https:\/\/www.courdecassation.fr\/decision\/6997fe47cdc6046d470bee68\">Cass. 3e civ., 19 February 2026 (no. 24-13.105)<\/a>, the same principle was applied to ice stalactites forming on roof edges above pedestrian walkways: the danger to personal safety, even in the absence of an actual accident, rendered the building unfit for its purpose within the meaning of Article 1792.<\/p>\n<p>Why does this matter for energy performance? The risk to the occupants\u2019 health from prolonged exposure to cold or damp, even if no specific illness has been diagnosed, could, by analogy with the 2023 case law, engage the builder\u2019s strict liability. A foreign buyer purchasing a newly built or recently renovated property who discovers severe energy performance failures within ten years of completion should therefore consider whether the <em>garantie d\u00e9cennale<\/em>, rather than (or in addition to) the <em>garantie des vices cach\u00e9s<\/em>, provides a remedy.<\/p>\n<p>Finally, foreign buyers should note the general obligation imposed on sellers by Article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006441518\" class=\"kohen-legifrance-popup-link\" data-kohen-legifrance-url=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006441518\" data-kohen-legifrance-title=\"Texte officiel Legifrance\" target=\"_blank\" rel=\"noopener\">1602<\/a> of the Civil Code: \u201c<em>le vendeur est tenu d\u2019expliquer clairement ce \u00e0 quoi il s\u2019oblige. Second, the progressive rental ban means that any property rated E, F, or G is exposed to a legally imposed loss of rental income at a known future date; renovation planning cannot be deferred indefinitely. Third, French co-ownership law imposes specific majority requirements for energy renovation works, and the syndic bears personal liability for failing to execute works that the general assembly has approved.
